<br />14. Receiver . Upon the commencement or during the pendency of a trustee's sale or an action to judicially foreclose this
<br />Deed of Trust, or enforce any other remedies of Beneficiary under the Deed of Trust, without regard to the adequacy or
<br />inadequacy of the Property as security for the Obligations, Trustor agrees that the court may appoint a receiver of the Property
<br />without bond, and may empower the receiver to take possession of the Property and collect the rents, issues and profits of the
<br />Property and exercise such other powers as the court may grant until the confirmation of sale, and may order the rents, issues
<br />and profits, when so collected, to be held and applied as the court may direct.
<br />15. Foreclosures. Beneficiary may also bring an action in any court of competent jurisdiction to foreclose this Deed of Trust in the
<br />manner provided by law for the foreclosure of mortgages on real property or to obtain specific enforcement of any of the covenants
<br />or agreements in this Deed of Trust. If Beneficiary brings such an action, Trustor agrees to pay Beneficiary's attorneys' fees as set by
<br />the court (and not a jury) and court costs. To the extent permitted by law, Beneficiary may maintain an action for a deficiency
<br />judgment.
<br />16. Expenses. To the extent not prohibited by law, Trustor shall pay all reasonable costs and expenses before and after judgment,
<br />including without limitation, attorneys' fees, appraisal fees, fees and expenses for environmental assessments, inspections and
<br />audits, and fees and expenses for obtaining title evidence incurred by Beneficiary in protecting or enforcing its rights under
<br />this Deed of Trust.
<br />17. Waiver of Dower, Homestead, and Distributive Share. Trustor relinquishes all right of dower, if any, and waives all right
<br />of homestead exemption and distributive share in and to the Property. Trustor waives any right of exemption as to the Property.
<br />18. Severability; Governing Law. The validity, construction and enforcement of this Deed of Trust are governed by the internal
<br />laws of Nebraska, except to the extent such laws are preempted by federal law. All references in this Deed of Trust to sections of the
<br />Nebraska Statutes are to those sections as they may be renumbered from time to time. Invalidity or unenforceability of any
<br />provision of this Deed of Trust will not affect the validity or enforceability of any other provision.
<br />19. Successors and Assigns. The obligations of all Trustors are joint and several. This Deed of Trust benefits Trustee and
<br />Beneficiary, their respective successors and assigns, and binds Trustor(s) and their respective heirs, personal representatives,
<br />successors and assigns.
<br />20. Entire Agreement. This Deed of Trust is intended by Beneficiary and Trustor as a final expression of this Deed of Trust and
<br />as a complete and exclusive statement of its terms, there being no conditions to enforceability of this Deed of Trust. To the extent
<br />not prohibited by applicable law, this Deed of Trust may not be contradicted or varied by evidence of prior,
<br />contemporaneous or subsequent oral agreements or discussions of Beneficiary and Trustor. There are no oral
<br />agreements among Beneficiary and Trustor. This Deed of Trust may not be supplemented or modified except in writing signed by
<br />Beneficiary and Trustor.
<br />21. Other Provisions. (If none are stated below, there are no other provisions.)
<br />The Trustor agrees to the terms of this Deed of Trust and acknowledges receipt of an exact copy of this Deed of Trust.
