<br />THIS DEED OF TRUST is made this 19th day of September, 2001. The
<br />Trustor (whether one or more) is Marvin Krueger and Gail Krueger, a /k /a
<br />Marvin B. Krueger and Gail A. Krueger, husband and wife, whose address
<br />for purposes of notices in respect to this Deed of Trust is 2315 S.
<br />August, Grand Island, Nebraska, and is sometimes herein identified as
<br />Borrower. The Trustee is Galen E. Stehlik, Attorney at Law and member
<br />of the Nebraska State Bar Association, whose address is 231 So. Locust,
<br />P. 0. Box 400, Grand Island, NE 68802. The Beneficiarys (whether one or
<br />more) are Wendy L. Tolzman, 10304 West Park Ridge Avenue, Wauwatosa,
<br />Wisconsin 53222; Maryann L. Shearer, 2509 East Laurel St., Mesa, Arizona
<br />85213; James L. Brownell, 2951 South 124th St., West Allis, Wisconsin
<br />53227; and Jeffrey P. Brownell, 8928 West Burdick Avenue, Milwaukee,
<br />Wisconsin 53227, and are sometimes herein identified as Lenders.
<br />BORROWERS IRREVOCABLY CONVEY TO TRUSTEE, IN TRUST, WITH POWER OF
<br />SALE, THE FOLLOWING:
<br />Lot Five (5), Block Four (4), Country Club Subdivision, Grand
<br />Island, Hall County, Nebraska (2315 South August, Grand
<br />Island, Nebraska),
<br />together with all buildings, improvements, fixtures, streets, alleys,
<br />passageways, easements, rights, privileges and appurtenances located
<br />thereon or in any way pertaining thereto, and the rents, issues, profits,
<br />reversions and the remainders thereof, and such personal property that
<br />iS at':ached to the improvements sJ as to conistltute a fixture, including,
<br />but limited to, heating and cooling equipment and together with the
<br />homestead or marital interests, if any, which interests are hereby
<br />released and waived, all of which, including replacements and additions
<br />thereto, is hereby declared to be a part of the real estate secured by
<br />the lien of this Deed of Trust and all of the foregoing being referred
<br />to herein as the "Property ".
<br />Borrowers owe Lenders the total sum of Forty Thousand Dollars
<br />($40,000.00), evidenced by Borrowers' Note of even date herewith
<br />(hereinafter referred to as "Debt ") which has a stated maturity date of
<br />September 19, 2002 (one year from date of issuance). This debt shall
<br />include any and all modifications, extensions and renewals thereof or
<br />thereto and any and all future advances and readvances to Borrowers (or
<br />any of them if more than one) hereunder pursuant to one or more
<br />promissory notes Borrowers (or any of them if more than one) hereunder
<br />pursuant to one or more promissory notes or credit agreements (herein
<br />called "Note ").
<br />This Deed of Trust secures to Lenders the Debt evidenced by said
<br />Note, the payment of all other sums, with interest, advanced under the
<br />provisions hereafter to protect the security and the performance of
<br />Borrowers' covenants and agreements.
<br />Borrowers covenant that Borrowers are lawfully seised of such real
<br />estate and have the legal power and lawful authority to convey the same
<br />and warrant and will defend title to the real estate against the lawful
<br />claims of all persons.
<br />BORROWERS AND LENDERS AGREE AS FOLLOWS:
<br />1. Borrowers shall pay when due, the principal and interest as
<br />provided in said Note. Payments shall be made to the law office trust
