<br />TRUSTEE'S DEED
<br />This instrument, made this A day of August, 2001 between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to
<br />a power of sale contained in that certain Deed of Trust recorded on August 25, 2000 as Instrument
<br />No. 2000 -06898 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, and Centex Credit Corporation d/b /a Centex Home Equity, hereinafter called "Grantee ":
<br />WHEREAS, on May 23, 2001, Eric H. Lindquist, as Successor Trustee, executed a Notice
<br />of Default pursuant to which notice was given to Christopher W. Callahan and Linda Callahan,
<br />Trustors, under that certain Deed of Trust recorded on August 25, 2000 as Instrument No. 2000-
<br />06898 of the Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska,
<br />covering that certain premises described as:
<br />Lot Two (2), Block One (1), Chamberlin's Addition to Wood River, Hall County, Nebraska,
<br />Excepting a certain tract therefrom as recorded in Warranty Deed in Book 120, Page 459
<br />AND
<br />The Westerly 34.1 feet of vacated street lying Easterly and abutting Lot Two (2), Block One (1),
<br />Chamberlin's Addition, Said vacated Street vacated by Ordinance No. 53 of the Ordinances of
<br />Wood River, Hall County, Nebraska. Ordinance recorded in Book K, Page 311 of the Register
<br />of Deeds Office, Hall County, Nebraska vacated Street described as follows: That all the Street
<br />be vacated on the West Side of Blocks "B" & "C" in First Addition and "F" & "G" in MacColl
<br />& Leflang's 2 °d Addition to Wood River, Hall County, Nebraska. Said Street commencing at a
<br />point and extending to and along the North line of Block `B" from the Northwest corner of said
<br />Block, 80 feet distant from the North West corner of said Block, thence running South to the
<br />South line of said Block "G" in said 2 °d Addition, being a strip or parcel of land lying parallel to
<br />and along West side of said Block `B ", "C ", "F" & "G" eighty feet wide,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on May 29, 2001 as Instrument No. 2001 -04977 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on July 16, 2001, Grantor caused to be published in 7-he
<br />Grand Island Daily Independant, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1" & Locust Street,
<br />Grand Island, Nebraska, at 10:00 a.m. on August 28, 2001. Publication of such notice was made
<br />for five consecutive weeks on July 16, 2001, July 23, 2001, July 30, 2001, August 6, 2001 and
<br />August 13, 2001 the last publication being at least ten (10) days but not more than thirty (30) days
<br />prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
