<br />MOUNTAIN TOWER & LAND, LLC, a Colorado limited liability company, herein
<br />called the Grantor, in consideration of the sum of One Dollar ($1.00), receipt of which is
<br />hereby acknowledged, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called the Grantee, a
<br />permanent and perpetual easement and right-of-way to survey, construct, inspect,
<br />maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities
<br />and appurtenances connected therewith, in, upon, above, along, over, across,
<br />underneath, and through a part of Lot Ten (10), Platte Valley Industrial Park Third
<br />Subdivision, in the City of Grand Isiand, Haii County, Nebraska, the easement and right-
<br />of-way tract being more particularly described as follows:
<br />Commencing at the Northwest corner of Lot Ten (10), Platte Valley Industrial
<br />Park Third Subdivision, in the City of Grand Island, Hall County, Nebraska;
<br />thence running along the northerly line of said Lot Ten (10), on an assumed
<br />bearing of S88°28'39"E, a distance of two hundred ninety-one and one tenth
<br />(291.1) feet; thence S1°31'21"W, a distance of forty-seven and five tenths
<br />(47.5) feet to a point on the southerly line of an existing twenty (20.0) foot
<br />wide utility easement described in Instrument #200309425, recorded in the
<br />Hall County, Nebraska Register of Deeds Office, said point being the
<br />ACTUAL Point of Beginning; thence continuing S1°31'21"W, a distance of
<br />ten (10.0) feet; thence S88°28'39"E a distance of fifty-five (55.0) feet; thence
<br />S1°31'21"W, a distance of one hundred twenty (120.0) feet; thence
