LUTH, husband and wife, <br />( "Trustor "), under that certain Deed of Trust in the original <br />principal amount of TWENTY - .STEVEN THOUSAND FIVE HUNDRED DOLLARS <br />( ;27,500.00), and dated July 1, 1990, to be entered into among <br />Trustor, and EARL D. AHLSCHWEDE, Attorney at Law, P. o. Box 2300, <br />Grand Island, Nebraska 68802, ( "Trustee "), and DAVID L. WALKOWIAK <br />and MARY K. WALKOWIAK, husband and wife, ( "Beneficiary ") , <br />covering the following - described property: <br />Lots Eleven (11) and Thirteen (13), in Block <br />Eighteen (18), in University Place, an <br />Addition to the City of Grand Island, Hall <br />County, Nebraska excepting a certain tract as <br />shown in warranty Deed recorded in Book 147, <br />Page 629, <br />hereby acknowledge that it is understood that (a) the Deed of <br />Trust to be executed by Trustor is a Trust Deed and not a <br />mortgage, and (b) the power of sale provided for in the Deed of <br />Trust provides substantially different rights and obligations to <br />the Trustor than a mortgage in the event of a default or breach <br />of obligation. <br />Trustor acknowledges that this Acknowledgment was Wade prior <br />to the execution of the Deed of Trust. ! <br />EXECUTED AND DELIVERED this 'tst day of Jv1y�, 1990. <br />T e f,q,reegoing instrument was acknowledged before me this 1&4 <br />day of- rT: 1990, by JACK A.
