Anderson a/k/a Derrick <br />Anderson, a single person, whose address is 205 W Mecca St, Cairo, NE 68824 ("Trustor") and Custer Federal State Bank, whose <br />address is 341 S 10th Ave, PO Box 310, Broken Bow, NE 68822 ("Lender"). <br />DEED OF TRUST. Lender and Trustor have entered into a Deed of Trust dated July 1, 2021 which has been recorded in Hall <br />County, State of Nebraska, as follows: <br />Recorded at Hall County Register of Deeds on July 1, 2021 as Instrument No 202105604 in the mortgage records. <br />REAL PROPERTY DESCRIPTION: The Deed of Trust covers the following described real property located in Hall County, State of <br />Nebraska: <br />Lots Twelve (12), and Thirteen (13), Block Nine (9), Original Town of Cairo, Hall County, Nebraska. <br />MODIFICATION. Lender and Trustor hereby modify the Deed of Trust as follows: <br />Details of the note secured by this lien instrument are modified as follows: <br />Date of the Note is August 26, 2021; Makers of the Note are Derrick R. Anderson a/k/a Derrick Anderson and Aleryn, Inc.; <br />Original Principal Amount of the Note is $62,000.00; Maturity Date of the Note is August 26, 2046. <br />Trustor presently assigns to Lender (also known as Beneficiary in this Deed of Trust) all of Trustor's right, title, and interest <br />in and to all present and future leases of the Property and all Rents from the Property. In addition, Trustor grants to Lender <br />a Uniform Commercial Code security interest in the Personal Property and Rents. <br />CONTINUING VALIDITY. Except as expressly modified above, the terms of the original Deed of Trust shall remain unchanged and <br />in full force and effect. Consent by Lender to this Modification does not waive lender's right to require strict performance of the <br />Deed of Trust as changed above nor obligate lender to make any future modifications. Nothing in this Modification shall <br />constitute a satisfaction of the promissory note or other credit agreement secured by the Deed of Trust (the "Note"). It is the <br />intention of lender to retain as liable all parties to the Deed of Trust and all parties, makers and endorsers to the Note, including <br />accommodation parties, unless a party is expressly released by Lender in writing. Any maker or endorser, including <br />accommodation makers, shall not be released by virtue of this Modification. If any person who signed the original Deed of Trust <br />does not sign this Modification, then all persons signing below acknowledge that this Modification is given conditionally, based on <br />the representation to Lender that the non -signing person consents to the changes and provisions of this Modification or <br />otherwise will not be released by it. This waiver applies not only to any initial extension or modification, but also to all such <br />subsequent actions. <br />
