After Recording Retum To: NEDCO, 4445 S. 86th Street, Suite 200, Lincoln, Nebraska 68526 <br />TERMINATION AND RELEASE OF THIRD PARTY LENDER AGREEMENT <br />On 11/08/2010, at the request of Nebraska Economic Development Corporation, Platte Valley State Bank <br />& Trust, as the Third Party Lender, executed a Third Party Lender Agreement whereby Platte Valley <br />State Bank & Trust made certain representations and commitments with respect to its loan to Kershner <br />Properties, L.L.C. or its affiliates (hereinafter "Borrower"). The Third Party Lender Agreement was <br />subsequently recorded on 11/10/2010 as Instrument No. 201008393 in the Records of Hall County, <br />Nebraska, relating to real estate described as: <br />2nd Amended Lot Four (4), Block Nine (9), Continental Gardens, an Addition to the City of Grand <br />Island, Hall County, Nebraska. <br />Since Platte Valley State Bank & Trust executed the Third Party Lender Agreement, the Borrower has <br />satisfied its obligation to the United States Small Business Administration and Nebraska Economic <br />Development Corporation; which necessitates the termination of the Third Party Lender Agreement and <br />Release of Platte Valley State Bank & Trust from its obligations under the Third Party Lender <br />Agreement. <br />Premised upon the foregoing, Nebraska Economic Development Corporation, as Attorney in Fact for the <br />United States Small Business Administration, an agency of the United States of America and assignee of <br />the Third Party Lender Agreement, hereby terminates the Third Party Lender Agreement and releases <br />Platte Valley State Bank & Trust from its obligations under the Third Party Lender Agreement. <br />Nebraska Economic Development Corporation, <br />Attorney -in- of.or the United States Small <br />Business A• ministration, <br />Scott Sai <br />resident <br />STATE OF NEBRASKA <br />) ss. <br />COUNTY OF LANCASTER ) <br />The foregoing instrument was acknowledged before me this 18th day of August, 2021 by Scott <br />Sailors, President of Nebraska Economic Development Corporation, as Attorney -in -Fact for the United <br />States Small Business Administration. <br />otary Public <br />JENNIFER FOWLER <br />State of Nebraska -General Notary <br />My Commission Expire <br />September 12. 2022 <br />ENTERED AS INSTRUMENT NO <br />
