0AA <br />0 <br />Cr' <br />Return to: Robert Gehm <br />NorthWestern Energy <br />3210 Douglas Avenue <br />Yankton, SD 57078 <br />GAS UTILITY EASEMENT <br />KNOW ALL MEN BY THESE PRESENTS: <br />That Little B's Corporation, a Nebraska corporation, the "Grantor", of 4444 West 13th Street, Grand <br />Island, Nebraska 68803, for and in consideration of the sum of One Dollar ($1.00) and other good and valuable <br />consideration, the receipt of which is hereby acknowledged, does hereby grant, remise, convey and relinquish unto <br />Northwestern Corporation, a Delaware corporation, d/b/a Northwestern Energy, the "Grantee", of 600 Market <br />Street West, Huron, South Dakota 57350, its successors or assigns, a gas utility easement for the installation, <br />maintenance and operation of an underground natural gas pipeline along with all appurtenances thereto over, under, <br />upon and through the following described lands situated in the County of Hall, the State of Nebraska, to -wit: <br />A 10 -foot -wide strip of land consisting of part of the Northeast Quarter (NE114) of Section Ten <br />(10), Township Eleven North (T11 N), Range Ten West (R10W) of the 6th Principal Meridian, Hall <br />County, Nebraska, containing 0.598 acres, more or less, and more particularly described as: <br />Commencing at the Northeast corner of said Section 10; thence on an assumed bearing of <br />South 89°49'01" West, along the North line of the Northeast Quarter (NE1/4), a distance of <br />50.00 feet; thence South 00°19'05" East, a distance of 33.00 feet to a point on the South <br />County road right-of-way line of Capital Avenue, and also being the Point of Beginning; <br />thence South 01°19'05" East, parallel to the East line of said NE1/4, a distance of 2,603.52 feet <br />to a point on the South line of said NE1/4; thence South 89°19'25" West, along said South <br />line, a distance of 10.00 feet; thence North 01°19'05" West, parallel to said East line of the <br />NE1/4 , a distance of 2,603.61 feet to a point on said South right-of-way line of Capital Avenue; <br />thence North 89°49'01" East, along said South right-of-way line, a distance of 10.00 feet to the <br />Point of Beginning; as illustrated in Exhibit "A" attached hereto. <br />[The purpose of the above described easement is for an underground natural gas pipeline <br />along with all appurtenances thereto (the "Facilities").] <br />TO HAVE AND TO HOLD unto said Grantee, its successors and assigns, so long as such Facilities shall be <br />maintained and operated, together with the right of ingress and egress from said premises for the purpose of <br />surveying, constructing, installing, inspecting, repairing, maintaining, renewing and replacing the property of the <br />Grantee located thereon, or removed thereof, in whole or in part, at the will of the Grantee. <br />ag <br />
