Delivery of an executed <br />signature page of this Agreement by facsimile transmission shall be as effective as delivery <br />of a manually executed counterpart thereof. <br />(g) No Merger. If fee title to the Premises and the leasehold estate of Tenant <br />pursuant to the Lease are held by the same person, such interest shall not merge but shall <br />remain separate and distinct. <br />(h) Recordation. This Agreement shall only be recorded at the option and <br />direction of Lender. <br />(i) Entire Agreement. This Agreement embodies the entire agreement of the <br />parties and supersedes all prior agreements and understandings, oral or written, relating to <br />the subject matter hereof. Lender and Tenant acknowledge and affirm that Lender or <br />Tenant, as the case may be, did not rely on any statement, oral or written, not contained in <br />this Agreement in making its decisions to enter into this Agreement. <br />(j) Severability.
