<br />EASEMENT
<br />This easement, made this aSday of May, 2021, between Phillip M. Dibbern, also known as Phillip Dibbern,
<br />and Lori L. Dibbern, husband and wife, Grantors, and Phillip M. Dibbern, also known as Phillip Dibbern, and Lori L.
<br />Dibbern, husband and wife, Grantees.
<br />WHEREAS, Grantors are the owners of a certain property in Hall County, Nebraska, legally described as:
<br />Lot One (1), Dibbern Subdivision, Hall County, Nebraska.
<br />and Grantees are the owners of the adjacent property in Hall County, Nebraska, legally described as:
<br />The Southwest Quarter (SW1/4) of Section Nineteen (19), Township Eleven (11) North, Range
<br />Eleven (11) West of the 6th P.M., Hall County, Nebraska, EXCEPT a tract more particularly described
<br />in Deed recorded in Book 78, Page 309, and EXCEPT a tract more particularly described in Warranty
<br />Deed recorded in Book 119, Page 157, and EXCEPT Lot One (1), Dibbern Subdivision, Hall County,
<br />Nebraska, as shown on the plat recorded as Document No. 94-103035.
<br />WHEREAS, Grantors are willing to grant to Grantees an easement for ingress and egress across the Easterly
<br />One Hundred Feet (E 100.0") of Grantor's property, for Grantees' pivot irrigation system in order for Grantees, and
<br />Grantees' agents, tenants and employees, to run a pivot irrigation system which is located on Grantees' property.

<br />THEREFORE, IT IS AGREED AS FOLLOWS:
<br />In consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, receipt of which
<br />is hereby acknowledged, Grantors do hereby grant to the Grantees, non-exclusive rights of ingress and egress only,
<br />across the Easterly One Hundred Feet (E 100.0") of Grantors' property, for Grantees' pivot irrigation system, in order
<br />for Grantees, and Grantees' agents, tenants, employees and assigns, to run a pivot irrigation system which is located
<br />on Grantees' property. Said easement shall allow Grantees' pivot to cross over the Easterly One Hundred Feet (E
<br />100.0') of Grantors' property, and for water from the pivot to fall on Grantors' property. Grantors further agree not to
<br />obstruct the path of the pivot across the easement portion of Grantors' property.
<br />This easement shall be perpetual and shall run with the land, and be binding upon the parties, their successors
<br />in interest and assigns, unless terminated in writing by the record owners of both parcels of real estate, which
<br />termination shall be filed of record.
