i <br />90-- 10'7142 <br />$�BDIVI$ION ACiREEI!lF.�II <br />Doniphan Railroad Subdivision <br />COMES NOW the Village of Doniphan, Hall County, Nebraska, a <br />Municipal Corporation, hereinafter referred to as First Party, and <br />the Butler /Sinion Group, LTD.. a Nebraska Corporation, hereinafter <br />referred to as Second Party. In consideration of approval by the <br />First Party of the Doniphan Railroad Subdivision to the Village of <br />Doniphan, Hall County, Nebraska. the Second Party agrees to remove - <br />all railroad tracks, rails and ties that cross any part of the land <br />dedicated as a street or alley to the Village of Doniphan as a part <br />of said subdivision. Upon removal of said railroad tracks, rails <br />and ties, the Second Party shall level and fill the area disturbed <br />by such removal and surface the same pursuant to Ordinance Number <br />180 of the Village of Doniphan, Hall County, Nebraska, a true and <br />correct copy of said Ordinance is attached hereto and made a part <br />-hereof by reference. Provided however, that after the railroad <br />tracks, rails and ties are removed from the street dedicated north <br />of lot one (1) , block two (2) in the Doniphan Railroad Subdivision <br />which is a gravel street, the surface shall be leveled, tamped and <br />gravel placed upon the surface thereof.
