<br />That Chad M. Nabity and Katherine K. Nabity, husband and wife, as joint tenants with rights of
<br />survivorship and not as tenants in common, the "Grantor", of the county of Hall, the state of Nebraska, for and in
<br />consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, the receipt of which is
<br />hereby acknowledged, does hereby grant, remise, convey and relinquish unto Northwestern Corporation, a
<br />Delaware Corporation, d/b/a Northwestern Energy, the "Grantee", of Huron, South Dakota, its successors or
<br />assigns, a gas utility easement for the installation, maintenance and operation of a natural gas pipeline along with all
<br />appurtenances thereto over, under, upon and through the following described lands situated in the county of Hall, the
<br />state of Nebraska, to -wit:
<br />A 10 -foot -wide strip of land consisting of part of the North Half of the Northwest Quarter of
<br />Northwest Quarter (N1/2 NW1/4 NW1/4) of Section Fourteen (14), Township Eleven North
<br />(T11 N), Range Ten West (R10W) of the 6th Principal Meridian, Hall County, Nebraska,
<br />containing, and more particularly described as follows:
<br />Commencing at the Northwest corner of said Section 14; thence on an assumed bearing of
<br />North 89°58'48" East, along the North line of the Northwest Quarter (NW1/4), a distance of
<br />50.00 feet; thence South 00°13'35" East, a distance of 50.00 feet to a point on the South right-
<br />of-way line of 13th Street and also being the Point of Beginning; thence North 89°58'48" East,
<br />along said South right-of-way line, a distance of 10.00 feet; thence South 00°13'35" East,
<br />parallel to the West line of said NW1/4, a distance of 628.38 feet; thence North 89°42'49" West,
<br />a distance of 10.00 feet; thence North 00°13'35" West, parallel to the West line of said NW1/4,
<br />a distance 628.33 feet to the Point of Beginning; as illustrated in attached Exhibit "A". Said
<br />strip of land containing 0.144 acres, more or Tess.
<br />[The purpose of the above described easement is for a natural gas pipeline along with all
<br />appurtenances thereto (the "Facilities").]
<br />TO HAVE AND TO HOLD unto said Grantee, its successors and assigns, so long as such Facilities shall be
<br />maintained and operated, together with the right of ingress and egress from said premises for the purpose of
<br />surveying, constructing, installing, inspecting, repairing, maintaining, renewing and replacing the property of the
<br />Grantee located thereon, or removed thereof, in whole or in part, at the will of the Grantee.
