202101954 <br />(g) Reconveyance. Upon payment of all sums secured by this Deed of Trust, Lender shall <br />request Trustee to reconvey the Property, and shall surrender this Deed of Trust and all <br />documents evidencing indebtedness secured by this Deed of Trust to Trustee. Trustee shall <br />reconvey the Property, without warranty, to the person or persons legally entitled thereto. Trustor <br />shall pay all costs of recordation, if any. <br />(h) Liens and Encumbrances. Trustor hereby warrants and represents that there is no <br />mortgage, deed of trust, lease or purchase contract describing all or any part of the Property, or <br />other contract, instrument or agreement constituting a lien or encumbrance against all or any part <br />of the Property. <br />(1) Application of Payments. Unless otherwise required by law or as specifically provided <br />herein, sums paid to Lender hereunder, including, without limitation, payments of principal and <br />interest, insurance proceeds, condemnation proceeds and rents and profits, shall be applied by <br />Lender to the amounts due and owing from Trustor in such order as Lender in its sole discretion <br />deems desirable. <br />(j) Severability. If any provision of this Deed of Trust conflicts with applicable law, or is <br />declared invalid or otherwise unenforceable, such conflict or invalidity shall not affect the other <br />provisions of this Deed of Trust or the other Loan Documents, which can be given effect without <br />the conflicting provision and, to this end, the provisions of this Deed of Trust and the other Loan <br />Documents are declared to be severable. <br />(k) Terms. All terms defined herein include the plural as well as the singular. <br />(1) Governing Law. This Deed of Trust shall be governed by the laws of the State of <br />Nebraska. <br />(m) Title Insurance and Recording Fees. Trustor shall provide Lender with a lender's <br />policy of title insurance from Obi & o Th5t Li -cc. Cbmponyy , in the <br />amount of the indebtedness secured hereby, which insures marketable lite to the Property in <br />Trustor, and which insures the lien created hereby as a first lien on the Property. Trustor shall <br />pay all premiums associated with such lender's policy of title insurance. Trustor shall also be <br />responsible for all fees associated with the recording of this Deed of Trust. <br />(n) Construction. Trustor acknowledge and agree that the Lender and the Trustor have <br />each participated in the drafting of this Deed of Trust, and that this Deed of Trust has been <br />reviewed by the respective legal counsel for such parties, and that the normal rule of construction <br />to the effect that any ambiguities are to be resolved against the drafting party shall not be applied <br />to the interpretation of this Deed of Trust.
