Rasmussen, a member of the Nebraska State Bar Association, <br />whose mailing address is 121 S. 13th Street, Suite 800, Lincoln, Nebraska 68508 (the "Trustee"), and ITM <br />LLC, a Nebraska Limited Liability Company, whose address is PO Box 22965, Lincoln NE 68542-2965 <br />(the "Lender"). <br />FOR VALUABLE CONSIDERATION, including Lender's extension of credit identified herein to <br />Trustor and the trust created herein, the receipt of which is hereby acknowledged, Trustor hereby <br />irrevocably grants, transfers, conveys and assigns to Trustee, IN TRUST, WITH POWER OF SALE, for <br />the benefit and security of Lender, under and subject to the terms and conditions hereinafter set forth, the <br />real property legally described on Exhibit A, attached hereto and incorporated herein by this reference, <br />together with all buildings, improvements, fixtures, streets, alleys, passageways, easements, rights, <br />privileges and appurtenances located thereon or in any way pertaining thereto, and the rents, issues and <br />profits, reversions and remainders thereof, and such personal property that is attached to the <br />improvements so as to constitute a fixture, all of which, including replacements and additions thereto, is <br />hereby declared to be a part of the real estate secured by the lien of this Deed of Trust, and all of the <br />foregoing being referred to herein as the "Property". <br />This Deed of Trust shall secure: (a) the payment of all principal, interest and other indebtedness <br />and obligations owed to Lender by Trustor, as evidenced by that certain Promissory Note of even date <br />herewith, in the original principal amount of $60,000, executed by Trustor in favor of Lender, and any and <br />all modifications, extensions, replacements, substitutions and renewals thereto (the "Note"), and all <br />documents and instruments executed and delivered pursuant thereto or contemplated thereunder <br />including, without limitation, this Deed of Trust, and all security agreements, financing statements, <br />assignments, guarantees and any and all modifications, extensions, replacements, substitutions and <br />renewals thereof or thereto (all of which, together with the Note, are collectively referred to herein as the <br />"Loan Documents"); (b) the payment of other sums advanced by Lender to protect the security of the <br />Loan Documents; (c) the performance of all covenants and agreements of Trustor set forth herein; and <br />(d) all present and future indebtedness and obligations owed to Lender by Trustor, whether direct, <br />indirect, absolute or contingent, and whether arising by note, guaranty, overdraft or otherwise. <br />1 <br />
