Walsh <br />/ 104 N Wheeler Avenue <br />i/ Grand Island NE 68801-6015 <br />AMENDMENT TO DECLARATION OF CONDOMINIUM AND <br />CREATION OF UNIT OWNERS ASSOCIATION FOR <br />ISLAND WEST PLAZA CONDOMINIUM PROPERTY REGIME <br />THIS AMENDMENT is made this �L day of March, 2021, by the undersigned, being <br />the current owners of all units contained in the condominium identified as ISLAND WEST <br />PLAZA CONDOMINIUM PROPERTY REGIME, (hereinafter referred to as "Owner") for <br />themselves and for their successors, grantees, and assigns. <br />WITNESSETH: <br />WHEREAS, a DECLARATION OF CONDOMINIUM AND CREATION OF UNIT <br />OWNERS ASSOCIATION FOR ISLAND WEST PLAZA CONDOMINIUM PROPERTY <br />REGIME (hereinafter referred to as "the Declaration") was filed in the Office of the Register of <br />Deeds of Hall County, Nebraska, on July 18, 2005, as Instrument No. 0200506707, which <br />Declaration was recorded against the following described real estate, to -wit: <br />Lots One (1) through Three (3), Setag Subdivision to the City of Grand Island, Hall <br />County, Nebraska; and <br />WHEREAS, pursuant to Article V and Article VI of the Declaration, Island West Plaza <br />Condominium Unit Owners' Association, Inc., a Nebraska nonprofit corporation (the <br />"Association") has been organized and incorporated for the purposes stated in the Declaration; and <br />WHEREAS, Article XII of the Declaration provides that the Declaration may be amended <br />by affirmative vote of unit owners to which at least Sixty -Seven Percent (67%) of the votes in the <br />Association are allocated; and <br />WHEREAS, there are currently Fourteen (14) units in ISLAND WEST PLAZA <br />CONDOMINIUM PROPERTY REGIME, with the owner of each of said units being a Class A <br />Member of the Association and entitled to one (1) vote in the Association for each unit owned; <br />and <br />WHEREAS, pursuant to the terms of the Declaration, Class B membership has ceased due <br />to the conveyance of at least Seventy -Five Percent (75%) of the units in ISLAND WEST PLAZA <br />CONDOMINIUM PROPERTY REGIME to owners other than the Declarant, as that term is <br />defined is the Declaration; and <br />WHEREAS, the undersigned, as the owners of all units in ISLAND WEST PLAZA <br />CONDOMINIUM PROPERTY REGIME, desire to amend the Declaration. <br />KNOW ALL MEN BY THESE PRESENTS: <br />1. Section 2.0 of the Declaration is hereby amended to read as follows: <br />2.0 Description of the Condominium.
