Walsh / 104 N Wheeler Avenue i/ Grand Island NE 68801-6015 AMENDMENT TO DECLARATION OF CONDOMINIUM AND CREATION OF UNIT OWNERS ASSOCIATION FOR ISLAND WEST PLAZA CONDOMINIUM PROPERTY REGIME THIS AMENDMENT is made this �L day of March, 2021, by the undersigned, being the current owners of all units contained in the condominium identified as ISLAND WEST PLAZA CONDOMINIUM PROPERTY REGIME, (hereinafter referred to as "Owner") for themselves and for their successors, grantees, and assigns. WITNESSETH: WHEREAS, a DECLARATION OF CONDOMINIUM AND CREATION OF UNIT OWNERS ASSOCIATION FOR ISLAND WEST PLAZA CONDOMINIUM PROPERTY REGIME (hereinafter referred to as "the Declaration") was filed in the Office of the Register of Deeds of Hall County, Nebraska, on July 18, 2005, as Instrument No. 0200506707, which Declaration was recorded against the following described real estate, to -wit: Lots One (1) through Three (3), Setag Subdivision to the City of Grand Island, Hall County, Nebraska; and WHEREAS, pursuant to Article V and Article VI of the Declaration, Island West Plaza Condominium Unit Owners' Association, Inc., a Nebraska nonprofit corporation (the "Association") has been organized and incorporated for the purposes stated in the Declaration; and WHEREAS, Article XII of the Declaration provides that the Declaration may be amended by affirmative vote of unit owners to which at least Sixty -Seven Percent (67%) of the votes in the Association are allocated; and WHEREAS, there are currently Fourteen (14) units in ISLAND WEST PLAZA CONDOMINIUM PROPERTY REGIME, with the owner of each of said units being a Class A Member of the Association and entitled to one (1) vote in the Association for each unit owned; and WHEREAS, pursuant to the terms of the Declaration, Class B membership has ceased due to the conveyance of at least Seventy -Five Percent (75%) of the units in ISLAND WEST PLAZA CONDOMINIUM PROPERTY REGIME to owners other than the Declarant, as that term is defined is the Declaration; and WHEREAS, the undersigned, as the owners of all units in ISLAND WEST PLAZA CONDOMINIUM PROPERTY REGIME, desire to amend the Declaration. KNOW ALL MEN BY THESE PRESENTS: 1. Section 2.0 of the Declaration is hereby amended to read as follows: 2.0 Description of the Condominium.
