WAGONER, a <br />single person, hereinafter called the GRANTOR; in consideration of One Hundred <br />Twenty-five Thousand Dollars ($125,000.00), does hereby give, grant, and convey unto <br />the CITY OF WOOD RIVER, NEBRASKA, a municipal corporation, GRANTEE, a <br />perpetual easement and right-of-way over, across, under, through, and upon the <br />following -described real estate, to -wit: <br />See attached EXHIBIT "A" for legal description of easement area. <br />Said easement includes but is not limited to the right to install, construct, <br />maintain and replace the drainage ditch and other public utility facilities by the <br />GRANTEE in, over and under the described easement area in connection with its <br />drainage project. It is further provided that said easement shall be deemed to provide <br />GRANTEE with the right of unrestricted access to its drainage ditch by ingress and <br />egress over, across, through, and under the lands described herein, together with all <br />rights of ingress and egress necessary for the full and complete use, occupation, and <br />enjoyment of the easement hereby granted, including the right to excavate and refill <br />ditches and trenches and appurtenant structures related thereto, and hereby prohibiting <br />the planting of trees, bushes, and shrubs, or placing other obstructions, in, upon, above, <br />along, over, across, underneath, and through the easement area. <br />To have and to hold the same unto the said GRANTEE and its successors and <br />assigns as appurtenant to the land and every part thereof; and GRANTORS hereby <br />dedicate their respective interests in said real estate to the use of the GRANTEE. This <br />easement is perpetual and shall run with the land. <br />In addition to the perpetual easement granted hereinabove, GRANTOR, for the <br />purpose of permitting initial construction, stockpiling of materials, parking of equipment, <br />and encroachment necessary to construct said drainage ditch and related matters, <br />
