200009481 <br />AGREEMENT SUBORDINATING A MORTGAGE <br />This Agreement is made this 19th day of October, 2000, by and between Five <br />Points Bank Grand Island, A Nebraska Corporation, of Grand Island, Nebraska, herein <br />referred to as FIVE POINTS BANK, and ru C LU itable Building and Loan Association <br />of Grand Island, Nebraska, A Federal Savings Bank, which has a principal place of <br />business in Hall County, Nebraska, herein referred to as Lender. <br />" The parties recite and declare that: <br />dated April 4, 1996, which Mortgage is recorded in the Register of Deeds <br />Office of Hall County, Nebraska on April 10, 1996, as Document Number 96- <br />102637 of that County, covering, in part, the following described property: <br />The East Fourteen Feet (E14') of lot six (6), and the West Forty -two <br />(W42') of Lot Seven (7), Franzen Subdivision, Grand Island, Hall County, <br />Nebraska. <br />B. Lender is about to loan the sum of Ten Thousand Dollars and No Cents <br />($10,000.00) on a Note and Deed of Trust securing such Note to provide for <br />the payment of a Note to Lender secured by a Deed of Trust filed against the <br />above described property. <br />C. To induce Lender to make such loan, it is necessary that the Mortgage held by <br />FIVE POINTS BANK, described in Section A above, be subordinated to the <br />lien of the Deed of Trust about to be made in favor of the Lender as <br />beneficiary as set forth above as it applies to the above described property <br />only. <br />For the reasons set forth above, and consideration of the mutual covenants and <br />promises of the parties hereto, FIVE POINTS BANK and Lender covenant <br />and agree as follows: <br />1. Subordination. FIVE POINTS BANK hereby covenants, consents and <br />agrees with Lender that the above - mentioned Mortgage is and shall <br />continue to be subject to and subordinate in lien to the lien of the Deed <br />of Trust about t6-bE ind o- -Udder stated above. <br />2. Consideration. In consideration of FIVE POINTS BANK so <br />subordinating the Mortgage held by it to the Deed of Trust made to <br />Lender, Lender shall make the above described loan to John J Mueller <br />and Barbara J Mueller, secured by a Deed of Trust identified as <br />document Numbers Qpo d 13 filed on , 2000, in the <br />Register of Deeds Office of Hall County, Nebraska <br />3. This Agreement shall be binding upon and inure to the benefit of the <br />legal representatives, successors and assigns of the parties hereto. <br />
