200009481 AGREEMENT SUBORDINATING A MORTGAGE This Agreement is made this 19th day of October, 2000, by and between Five Points Bank Grand Island, A Nebraska Corporation, of Grand Island, Nebraska, herein referred to as FIVE POINTS BANK, and ru C LU itable Building and Loan Association of Grand Island, Nebraska, A Federal Savings Bank, which has a principal place of business in Hall County, Nebraska, herein referred to as Lender. " The parties recite and declare that: dated April 4, 1996, which Mortgage is recorded in the Register of Deeds Office of Hall County, Nebraska on April 10, 1996, as Document Number 96- 102637 of that County, covering, in part, the following described property: The East Fourteen Feet (E14') of lot six (6), and the West Forty -two (W42') of Lot Seven (7), Franzen Subdivision, Grand Island, Hall County, Nebraska. B. Lender is about to loan the sum of Ten Thousand Dollars and No Cents ($10,000.00) on a Note and Deed of Trust securing such Note to provide for the payment of a Note to Lender secured by a Deed of Trust filed against the above described property. C. To induce Lender to make such loan, it is necessary that the Mortgage held by FIVE POINTS BANK, described in Section A above, be subordinated to the lien of the Deed of Trust about to be made in favor of the Lender as beneficiary as set forth above as it applies to the above described property only. For the reasons set forth above, and consideration of the mutual covenants and promises of the parties hereto, FIVE POINTS BANK and Lender covenant and agree as follows: 1. Subordination. FIVE POINTS BANK hereby covenants, consents and agrees with Lender that the above - mentioned Mortgage is and shall continue to be subject to and subordinate in lien to the lien of the Deed of Trust about t6-bE ind o- -Udder stated above. 2. Consideration. In consideration of FIVE POINTS BANK so subordinating the Mortgage held by it to the Deed of Trust made to Lender, Lender shall make the above described loan to John J Mueller and Barbara J Mueller, secured by a Deed of Trust identified as document Numbers Qpo d 13 filed on , 2000, in the Register of Deeds Office of Hall County, Nebraska 3. This Agreement shall be binding upon and inure to the benefit of the legal representatives, successors and assigns of the parties hereto.
