<br />TRUST DEED
<br />THIS DEED OF TRUST is made on December 3/5 2020. The Trustors are Royce
<br />Carville and Janice Carville, husband and wife, whose address is 1875 Deer Park Cir S, Grand
<br />Junction, CO 81507-9581, as to Parcel A, and FX -GIN, L.L.C., a Colorado Limited Liability
<br />Company, whose address is 1875 Deer Park Cir S, Grand Junction, CO 81505, as to Parcel B,
<br />(hereinafter collectively "Grantor"). The Trustee is Denise D. Myers, attorney at law, of Myers
<br />Law Office, 415 S. High Street, P.O. Box 505, Cairo, Nebraska 68824, ("Trustee"). The
<br />beneficiary is Timberline Bank, whose address is Grand Junction, 649 Market St., Grand Junction,
<br />CO, 81505 (hereinafter referred to below sometimes as "Lender" and sometimes as
<br />"Beneficiary"). Grantor owes Lender a sum of money for which Lender's lien under this Deed of
<br />Trust shall not exceed at any one time the sum of Three Million Five Hundred Thousand and
<br />00/100 Dollars ($3,500,000.00), except as allowed by law. This Deed of Trust (sometimes
<br />referred to herein as "security instrument") secures to Lender: (a) the repayment of the debt
<br />owed to Lender and all renewals, extensions and modifications; (b) the payment of all other sums
<br />advanced under paragraph 4 to protect the security of this Security Instrument; and (c) the
<br />performance of Grantor's covenants and agreements. For this purpose, Grantor irrevocably
<br />grants and conveys to Trustee, in trust, with power of sale, the following described property
<br />located in Hall County, Nebraska:
<br />Parcel A: Lot One (1), Platte Valley Industrial Park Eighth Subdivision, an
<br />Addition to the City of Grand Island, Hall County, Nebraska.
<br />Parcel B: Lot Two (2), Platte Valley Industrial Park Eighth Subdivision, an
<br />Addition to the City of Grand Island, Hall County, Nebraska.
<br />The real property or its address is commonly known as 4201 Gold Core Drive, Grand
<br />Island, NE 68801.
<br />TOGETHER WITH all the improvements now or hereafter erected on the property, and all
<br />easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water
<br />rights and stock and all fixtures now or hereafter a part of the property. All replacements and
<br />additions shall also be covered by this Security Instrument. All of the foregoing is referred to in
<br />this Security Instrument as the "Property".
<br />GRANTOR COVENANTS that Grantor is lawfully seised of the estate hereby conveyed
<br />and has the right to grant and convey the Property and that the Property is unencumbered.
<br />Grantor warrants and will defend generally the title to the Property against all claims and
<br />demands, subject to any encumbrances of record.
<br />COVENANTS. Grantor and Lender covenant and agree as follows:
<br />1. Payment of Principal; Prepayment and Late Charges. Grantor shall promptly pay
<br />when due the principal on the debt evidenced by the Note and any prepayment and late charges
<br />due under the Note. Prepayment of principal or any part thereof, shall not be allowed without
<br />the prior written consent of Lender.
