MENARD, JR., a married person and a resident of the State of <br />Wisconsin ("Grantor"), in consideration of Ten Dollars and other good and valuable <br />consideration received from Kayton Grand Island, LLC, a Nebraska limited liability <br />company ("Grantee"), conveys to Grantee the following described real estate in the City <br />of Grand Island, Hall County, Nebraska: <br />LOT TWO (2), MENARD EIGHTH SUBDIVISION, IN THE CITY OF <br />GRAND ISLAND, HALL COUNTY, NEBRASKA, <br />hereinafter referred to as the "Property," <br />Together with all and singular the hereditaments and appurtenances thereunto <br />belonging, or in anywise appertaining and remainders, and the revision and reversions, <br />remainder, rents, issues and profits thereof: TO HAVE AND TO HOLD the Property as <br />above described, with the appurtenances, unto the Grantee forever. <br />And the Grantor, for itself, and its successors, does covenant, promise and agree, <br />to and with the Grantee, that it has not done or suffered to be done, anything whereby the <br />Property hereby granted is, or may be, in any manner encumbered or charged, except as <br />herein recited; and that the Property, against all persons lawfully claiming, or to claim the <br />same, by, through or under Grantor and none other, it WILL WARRANT AND <br />DEFEND, subject to: general real estate taxes and assessments not yet due and payable, <br />and special assessments caused by Grantee's activities or improvements; acts of Grantee <br />and those parties claiming by, through and under Grantee; building and zoning laws; <br />county and municipal ordinances; state and federal regulations; easements, covenants and <br />restrictions apparent or of record; and the following covenants which Grantor shall <br />reserve for its use, and the use of its successors or assigns, as an appurtenance to the <br />Property: <br />Site Development Approval: In order to ensure that the area consisting <br />of Grantor's adjacent property and the Property is developed and <br />maintained as a cohesive development, that the development of the <br />rn <br />rn <br />rn <br />N Ci" <br />CD <br />N (n <br />H <br />o <br />• rn <br />O -1 <br />co <br />c4,1 <br />
