<br />HOMESTEAD DESIGNATION DISCLAIMER

<br />In accordance with the provisions of the Nebraska Farm Homestead Protection Act, Neb. Rev. Stat.
<br />Sections 76-1901, et. seq., as a preface to the execution, and as a part of the following Deed of
<br />Trust, the undersigned Trustor(s), being first duly sworn, elects to Disclaim the Right to Designate a
<br />Homestead.
<br />I/We disclaim the right to designate a homestead on the property described in the following Deed of
<br />Trust. No part of my/our homestead is presently, or in the future will be, situated upon said real
<br />estate. I/We understand that if I/we establish a homestead on any part of the real estate during the
<br />time the Deed of Trust remains unsatisfied and a lien on the real estate, I/we shall have no right to
<br />make a designation of homestead in the event of a Trustee's sale.

<br />THIS DEED OF TRUST, made this q day of December , 20 a0 , by
<br />and between Garret Johnson, a single person, of the County of Hall and State of Nebraska,
<br />hereinafter called "Trustor" (whether one or more), and Zachary Butz, Attorney at Law, of Hall
<br />County, Nebraska, hereinafter called "Trustee," and Alvin Gosda and Cyndia Gosda, husband and
<br />wife, whose address is 5074 West White Cloud Rd., Grand Island, NE 68803, hereinafter called
<br />"Beneficiary";
<br />WITNESSETH, That the Trustor, for good and valuable consideration, including the debt
<br />and trust hereinafter mentioned and created, and the sum of one dollar to Trustor paid by the said
<br />Trustee, the receipt and sufficiency of which is hereby acknowledged, does by these presents,
<br />irrevocably grant, bargain and sell, convey, assign and confirm unto the said Trustee, IN TRUST,
<br />WITH POWER OF SALE, for the benefit and security of Beneficiary, under and subject to the
<br />terms and conditions of this Deed of Trust, the following described real property situated in Hall
<br />County, Nebraska, to -wit:

<br />Twelve (12) North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska,
<br />EXCEPTING a tract of land more particularly described in Warranty Deed filed in
<br />the Register of Deeds as Document No. 88-100008, and EXCEPTING a tract of land
<br />more particularly described in Warranty Deed filed in the Register of Deeds as
<br />Document No. 200906693.
<br />Parcel 2: The North Half of the Southwest Quarter (N`/2SW'/4) of Section Twenty-
<br />one (21) in Township Twelve (12) North, Range Ten (10) West of the 6`" P.M., Hall
<br />County, Nebraska
