After recording return to City Attorney, 100 East First Street, PO Box 1968, Grand Island, NE 68802.) /� <br />PARTIAL SATISFACTION AND RELEASE ,LT <br />LOTS ONE (1) THROUGH FORTY-ONE (41) IN BLOCK ONE (1), LOTS ONE (1) THROUGH TWENTY- <br />FIVE (25) IN BLOCK TWO (2), AND LOTS ONE (1) THROUGH ELEVEN (11) IN BLOCK THREE (3), <br />ALL IN <br />FAIRWAY CROSSING AT INDIANHEAD GOLF CLUB FIRST SUBDIVISION, IN THE CITY OF GRAND <br />ISLAND, HALL COUNTY, NEBRASKA <br />COMES NOW the City of Grand Island (hereinafter "City") and in consideration of the <br />conveyance of easements, construction of certain sanitary sewer facilities, and other good and <br />valuable consideration received from Indianhead Golf Club, L.L.C., successor by merger to <br />Indianhead Golf Club, Inc., A/K/A Indian Head Golf Club, Inc. (hereinafter "Subdivider"), City <br />does acknowledge partial satisfaction of that certain Subdivision Agreement, recorded on <br />February 24, 2010 as document number 201001208 in the Office of the Hall County Register of <br />Deeds (hereinafter the "Subdivision Agreement"), and hereby fully and completely releases <br />Subdivider and its successors in interests solely with respect to the following liabilities, <br />obligations and duties provided in and by the Subdivision Agreement, to wit: <br />The Subdivider shall install a sanitary sewer lift station in an easement to be <br />located on property located at the southwest corner of the intersection of Belfry <br />Boulevard and Augusta Parkway. The Subdivider shall construct a sewage force <br />main from said lift station to the existing public sanitary sewer main on <br />Indianhead Road west of Schroeder Avenue. The Subdivider shall construct a <br />gravity sanitary sewer main in public street right-of-way or in a public utility <br />easement for future use from the lift station to the location where a future <br />sanitary sewer main will be located along Husker Highway. The property being <br />developed is subject to a proportionate cost share for extending public <br />interceptor sanitary sewer in the future along Husker Highway where it abuts the <br />subdivision. The owner of each lot in the subdivision will be required to pay their <br />proportionate share of the cost for the Husker Highway interceptor sanitary <br />sewer main at the time of the application for a sanitary sewer service permit. <br />1 <br />
