AHLSCHWEDE, Attorney of Grand Island, Nebraska, hereinafter referred to as Grantor, as trustee under the trust deed hereinafter described for valuable consideration, hereby grants and conveys to Mike Leaman and Ralisa Leaman, husband and wife, Grantee, without any covenant or warranty, expressed or implied, all of the following described real estate: Lot Five (5), Block One (1), Lambert's Addition to the City of Grand Island, Hall County, Nebraska. This conveyance is made pursuant to the powers conferred on Grantor by a trust deed dated February 16, 1996, and recorded on February 26, 1996, in the Register of Deeds of Hall County, Nebraska as Document No. No. 96- 101312 wherein Ricky W. Patsios and Debra D. Patsios, husband and wife, are Trustors, and Grand Island Area Habitat for Humanity, Inc., a Nebraska Corporation, is named Beneficiary and Earl D. Ahlschwede, Attorney, is Trustee, wherein the Trustors granted and conveyed to such Trustee, on the trust therein expressed, the property above described to secure, among other obligations, payment of a promissory notes of even date in the principal amount of $42,778.63 and interest thereon according to the terms thereof; and after the fulfillment of the conditions specified in the Trust Deed authorizing this conveyance as follows: 1) Breach and default were made under the terms of the Trust Deed in the particular set forth in the notice of default hereinafter referred to, which default continued until the time of sale. 2) There was filed for record on June 12, 2001, as Document No. 200105641, a Notice of Default with the Register of Deeds of Hall County, Nebraska, and of election to sell the property to satisfy the obligations secured thereby and thereafter notice of the filing of the notice of default was sent in the statutory manner to all persons entitled to a notice thereof. 3) That thereafter the Grantor executed his notice of trustee's sale, stating that he, as trustee, would sell at public auction to the highest bidder the property hereinbefore described, fixing the time and place of the sale as August 28, 2001 at 1:30 p.m. in the lower lobby of the county courthouse in Grand Island, Hall County, Nebraska, and caused copies of such notice to be published once a week for five consecutive weeks in THE GRAND ISLAND DAILY INDEPENDENT a legal daily newspaper printed, published and of general circulation in the County of Hall, Nebraska, the first date of publication was July 16, 2001, and the last date of publication was August 13, 2001; notice of such trustee sale was sent to the Trustors and all persons entitled to notice thereof in accordance with applicable law. 4) All applicable statutory provisions of the State of Nebraska and the United States of America and all provisions of such trust deed have been complied with as to the acts to be performed and notices to be given.
