Return to: The Hoppe Law Firm <br />5631 S 48th St, #220 <br />Lincoln NE 68516 <br />THIS EASEMENT is made as of the 6 day of (\J1bCr-, 2020 by and between The Orchard, <br />LLC, as Grantor, and the Orchard Homeowners Association, as Grantee. <br />EASEMENT <br />CU <br />c. <br />WHEREAS, Grantor owns certain real property commonly known as The Orchard Subdivision in Grand <br />Island, Hall County, Nebraska, legally described on Exhibit A, the plat recorded as Instrument 201904284 with the <br />Hall County Register of Deeds, which is attached hereto and incorporated herein by this reference, except lots seven <br />(7), eight (8) and nine (9), Block One (hereinafter "the Premises"); and <br />WHEREAS, Grantee is the Homeowners Association of the Orchard Subdivision; and <br />WHEREAS, Grantee will require access and use of a portion of the Grantor Premises, such property being <br />described as follows: <br />The rear ten (10) feet of each lot as shown on the preliminary plat of the Orchard Subdivision. <br />WHEREAS, Grantor and Grantee desire to create an easement for the use of Easement Premises to allow <br />Grantee ingress, egress and access to allow for lawn care and maintenance of the properties within the homeowners <br />association in accordance with the terms hereof. <br />NOW, THEREFORE, for One Dollar ($1.00) and other good and valuable consideration, the receipt and <br />sufficiency of which is hereby acknowledged by the parties, the parties hereby agree as follows: <br />1. Recitals. The above recitals are true and correct. <br />2. Grantee Easement. Grantor hereby grants to Grantee, its members, employees and the invitees of <br />the members, an easement of ingress, egress, access and traverse across the rear ten (10) feet of all lots of the <br />subdivision as shown in the preliminary plat (Exhibit A), except lots seven (7), eight (8) and nine (9), Block One, of <br />the Orchard Subdivision. <br />3. Maintenance and Repairs. Responsibility for the cost, maintenance and repair of the Grantee <br />Easement Premises shall be paid by the owner of said lot. <br />4. Appurtenant Easement.
