<br />Donald R. Gill and Laurel K. Gill, husband and wife, being first duly sworn upon oath, depose and
<br />state that Donald R. Gill and Laurel K. Gill are the record owners of the real estate described below, and
<br />that they are currently in possession thereof, and have had possession since they acquired the property in
<br />1975, by way of a Survivorship Warranty Deed, dated January 25, 1975, and filed of record on February
<br />13, 1975, as Deed Record 177, Page 243, with the Hall County Register of Deeds:
<br />A tract of land in the West Half of the Northwest Quarter (W 1/2NW 1/4) of Section Four (4),
<br />Township Ten (10) North, Range Twelve (12) West of the 6th P.M., Hall County, Nebraska, and
<br />more particularly described as follows: Commencing at the Southwest Corner of the Northwest
<br />Quarter of Section Four (4), then east and along the south boundary of said section a distance of
<br />Four Hundred Thirty Five (435) feet, thence north and parallel to the west boundary of said
<br />section a distance of Four Hundred Eighty Five (485) feet, thence west and parallel to the south
<br />boundary of said section a distance of Four Hundred Thirty Five (435) feet, thence south along
<br />the west boundary of said section a distance of Four Hundred Eighty Five (485) feet to the point
<br />of beginning, said tract containing 4.8 acres more or less.
<br />The Survivorship Warranty Deed originally filed on February 13, 1975, contained an error in the
<br />legal description in that the underlined and bold portion as shown below was omitted from the original
<br />Survivorship Warranty Deed:
<br />A tract of land in the West Half of the Northwest Quarter (W1/2NW1/4) of Section Four (4),
<br />Township Ten (10) North, Range Twelve (12) West of the 6th P.M., Hall County, Nebraska, and
<br />more particularly described as follows: Commencing at the Southwest Corner of the Northwest

<br />Four Hundred Thirty Five (435) feet, thence north and parallel to the west boundary of said

<br />the west boundary of said section a distance of Four Hundred Eighty Five (485) feet to the point

<br />The current owners, Donald R. Gill and Laurel K. Gill, are in either actual possession of the said
<br />real estate and the whole thereof, and that the immediate and remote grantors have a continuous and
<br />unbroken record chain of title to such real estate and the whole thereof, for a period of more than Twenty -
<br />Three (23) years last past, and that during the time title to said premises have never been disputed. This
<br />affidavit is given pursuant to the Nebraska Marketable Title Act.
