STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the <br />terms and conditions, under which the Licensee may construct, maintain, repair, and utilize the following <br />described improvement which will infringe upon the public right-of-way: <br />Installation, maintenance, and repair of private electrical line in the public right-of-way adjacent to <br />the property addressed as 4776 S Locust Street, per attached Exhibit "A", dated 2020/10/14. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The following described real estate is <br />adjacent to the Licensor's public right-of-way to which this License Agreement shall apply: <br />Part of the southeast Quarter of the Southeast Quarter (SE1/4SE1/4) of Section Four (4), Township Ten <br />(10) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, described as follows: <br />Commencing at a point 33 feet west and 24.75 feet southerly from the northeast corner of the <br />SE1/4SE1/4 of said Section Four (4); thence running Southerly and parallel and 33 feet Westerly from <br />the east line of the SE1/4 of said Section Four (4), a distance 281.25 feet' thence Wasterly 246.4 feet; <br />thence Northerly and parallel to the East line of said SE1/4 of said Section Four (4), a distance of 281.25 <br />feet; thence Easterly 246.4 feet to the point of beginning, expecting a tract more particularly described in <br />Warranty Deed recorded as Document No. 99-108987 <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may <br />construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The <br />Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and <br />independent contractors for any damage or injury that may result to said improvement. If the Licensor, in <br />its sole discretion, determines that any part or all of the improvement must be removed or is damaged by <br />the Licensor, its employees, agents or independent contractors working for the Licensor during the <br />course of their employment or duties with the Licensor, the Licensee agrees to assume and pay all costs <br />relating to the replacement or repair of the improvement. Licensee indemnifies and holds the City <br />harmless from and against all claims arising out of the use or occupancy allowed under this agreement. <br />Licensee shall provide access at all times to the City easement on the north side of the subject property. <br />
