<br />Arthur E. Moeller, being first duly sworn upon hid or her oath, deposes and says:
<br />1. That the Affiant is the successor trustee under the terms and conditions of the Sharon
<br />A. Moeller Revocable Trust dated August 20, 2012, that following the death of Sharon A. Moeller
<br />became known as the Sharon A. Moeller Administration Trust (hereinafter referred to as the "said
<br />Trust").
<br />2. That on October 15, 2020, the Affiant became the trustee of the said Trust following
<br />the death of Sharon A. Moeller on September 21, 2020, the settlor and initial trustee of said Trust,
<br />a certified copy of her death certificate is attached as Exhibit "A", and upon signing an Acceptance
<br />to Act as Trustee under the Sharon A. Moeller Revocable Trust dated August 20, 2012, an original
<br />of which is attached as Exhibit "B".
<br />3. That the Affiant remains the sole trustee of the said Trust as of this date.
<br />4. That among the assets of the said Trust is the following described real property:
<br />An undivided one-half ('/2) interest in and to the Southeast Quarter (SE%) of
<br />Section Eleven (11), Township Twelve (12) North, Range Nine (9) West of the
<br />6th P.M., Hall County, Nebraska, EXCEPT a tract of land situated in the
<br />Southwest Quarter of the Southeast Quarter (SW'4SE%) of said Section 11
<br />conveyed to Charles W. Winter and Lenore A. Winter by Warranty Deed
<br />recorded in Book 163 at Page 397 of the Deed Records of Hall County,
<br />Nebraska, AND EXCEPT Lot One (1) in Moeller Subdivision, a tract of land
<br />located in the Southeast Quarter (SE%) of Section Eleven (11), Township
<br />Twelve (12) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska;
<br />AND EXCEPT FINALLY Lot One (1) in Moeller Second Subdivision, a tract
<br />of land located in the Southeast Quarter (SE%) of Section Eleven (11), Township
<br />Twelve (12) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska;
<br />and
<br />An undivided one-half (%z) interest in and to Lot One (1) in MOELLER
<br />SUBDIVISION located in the Southeast Quarter (SE%) of Section Eleven (11),
<br />Township Twelve (12) North, Range Nine (9) West of the 6`h P.M., Hall County,
<br />Nebraska.
<br />5. That pursuant to the terms of the said Trust and §30-3881(2) of the Nebraska Uniform
<br />Trust Code, the trustee of the said Trust has the power, without court authorization, to acquire or sell
<br />property, for cash or on credit, at public or private sale.
<br />6. That neither the said Trust or the trust instrument creating the said Trust, nor any part
<br />thereof, has been revoked, amended, or terminated, and the above statements constitute a full
<br />disclosure of all provisions concerning those items.
