Wheeler Avenue <br />Grand Island, NE 68801 <br />Access Easement Agreement <br />ACCESS EASEMENT AGREEMENT <br />hisccess Easement Agreement is made and executed this Aday of <br />4a,%,A, 2020 by and between BRIAN J. RASMUSSEN, hereinafter referred to as <br />"Grantor", and BRIAN D. LEVANDER, TRUSTEE OF THE BRIAN D. LEVANDER <br />RVOCABLE TRUST DATED OCTOBER 24, 2013, hereinafter referred to as "Grantee". <br />WITNESSETH: <br />WHEREAS, Grantor is the owner in fee simple of the following described real estate: <br />A part of Lot Two (2), Anthem Subdivision, Grand Island, Hall County, Nebraska, <br />described as follows: <br />Commencing at the Southeast Corner of Lot Two (2), Anthem Subdivision; thence on a <br />bearing of N00°58'58"E, a distance of 414.50 feet; thence S88°49'44"W, a distance of <br />50.00' feet; thence S00°58'58"E a distance of 443.35' feet; thence N58°53'29"E, a <br />distance of 57.81 feet to the point of beginning as reflected on the attached Exhibit "A" <br />incorporated herein and made a part hereof by this reference. <br />("Easement Area"); <br />WHEREAS, Grantee is the owner in fee simple of the following described real estate: <br />Lot One (1) Anthem Subdivision, Grand Island, Hall County, Nebraska ("Grantee's <br />Property"); <br />WHEREAS, Grantee desires to have ingress and egress over, through and upon the <br />Easement Area for access to/from Grantee's Property; and <br />WHEREAS, Grantor is willing to grant a perpetual non-exclusive easement to the <br />Grantee, its heirs, successors and assigns, over, through and upon the Easement Area. <br />NOW, THEREFORE, for good and valuable consideration, the receipt and adequacy of <br />which is hereby acknowledged, Grantor does hereby grant unto Grantee and to Grantee's heirs, <br />successors, invitees and assigns a perpetual non-exclusive easement over, through and upon the <br />Easement Area for ingress and egress access to provide Grantee access to Grantee's Property. <br />This easement shall be a perpetual non-exclusive easement, shall run with the land and shall <br />inure to and be binding upon the parties hereto, their heirs, successors and assigns and all parties <br />claiming ownership of Grantee's Property or Easement Area through the parties hereto. <br />IN WITNESS WHEREOF, the undersigned have executed this Access Easement <br />Agreement on the date first noted above. <br />
