<br />UTILITY EASEMENT AGREEMENT
<br />This Utility Easement Agreement (the "Easement" or "Agreement") is made this
<br />20th day of September, 2019, by GI Hospital Real Estate LLC, a Nebraska limited
<br />liability company ("GI Hospital" or "Grantor") and Prataria Ventures, LLC, a Nebraska
<br />limited liability company ("Prataria") and Prairie Commons MOB, LLC, a Nebraska
<br />limited liability company ("Prairie Commons") (collectively, Prataria and Prairie
<br />Commons are referred to herein as the "Grantee").
<br />RECITALS
<br />A. Prataria owns real property legally described as: Lot 3, Prairie Commons Second
<br />Subdivision, Grand Island, Hall County, Nebraska (the "Prataria Property").
<br />B. Prairie Commons owns real property legally described as Lot 2, Prairie Commons
<br />Second Subdivision, Grand Island, Hall County, Nebraska (the "Prairie Commons
<br />Property").
<br />C. GI Hospital owns real property legally described as: Lot 1, Prairie Commons
<br />Second Subdivision, Grand Island, Hall County, Nebraska (the "GI Hospital
<br />Property") .
<br />D. Grantee desires to obtain a utility easement for a sewer line across a portion of
<br />the GI Hospital Property as generally depicted and legally described on the
<br />attached and incorporated Exhibit "A".
<br />E. GI Hospital, as the owner of the GI Hospital Property, grants the easement set
<br />forth herein to Prataria, as the owner of the Prataria Property and Prairie
<br />Commons as the owner of the Prairie Commons Property, and any successors or
<br />assigns of the owner of the Prataria Property and the Prairie Commons Property.
