<br />This easement, made this /4 day of " , 2020, between Tyler Plejdrup a single
<br />person, Grantor, and Michael W. Lowry and Denise K. Lowry, husband and wife, Grantees.
<br />WHEREAS, Grantor is the owner of a certain property legally described as: Lot One (1), Townview
<br />Subdivision, Hall County, Nebraska ("Grantor's Property");
<br />AND WHEREAS, Grantees are the owners of adjacent property, legally described as: The
<br />Southwest Quarter (SW1/4) of Section Twenty -Four (24), Township Twelve (12) North, Range Twelve (12)
<br />West of the 6th P.M., Hall County, Nebraska, EXCEPTING THEREFROM Lot One (1), Lowry Acres, Hall
<br />County, Nebraska, and EXCEPTING THEREFROM Lot One (1) Townview Subdivision, Hall County,
<br />Nebraska ("Grantees' Property").
<br />WHEREAS, Grantees desire to obtain and Grantor is willing to grant a permanent access easement
<br />for ingress and egress to Grantees' property pursuant to the terms and conditions set forth herein upon the
<br />following described property:
<br />The northerly Fifteen Feet (15.0') of Lot One (1), Townview Subdivision, Hall County,
<br />Nebraska. ("Easement Property")
<br />NOW THEREFORE, in consideration of the sum of One Dollar ($1.00) and other good and valuable
<br />consideration, receipt of which is hereby acknowledged, it is agreed as follows:
<br />1. Grantor does hereby grant and convey to the Grantees, their successors and assigns, a
<br />perpetual easement for access purposes upon the Easement Property.
<br />2. "Access purposes" as used in the Easement Agreement means the right to the nonexclusive
<br />use of the Easement Property as a means of ingress and egress to and from Grantees' Property, buildings,
<br />and improvements by Grantees, their successors in interest, agents, tenants and assigns.
<br />3. Grantor shall maintain the Easement Property for access purposes in good repair. Neither
<br />Grantor nor Grantees will obstruct access to the easement granted herein.
<br />4. Subject to the terms set forth herein, this Easement shall run with the land and shall be binding
<br />upon the parties, their successors in interest and assigns.
<br />5. This Easement Agreement constitutes the entire agreement of the parties. Any modification of
<br />this Easement Agreement shall be binding only if evidenced in writing and signed by all record owners of
<br />Grantor's Property and Grantee's Property.
