<br />GAS UTILITY EASEMENT
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That Arlene 0. Mettenbrink, as Trustee of the Arlene 0. Mettenbrink Living Revocable Trust, the
<br />"Grantor", of the county of Hall, the state of Nebraska, for and in consideration of the sum of One Dollar ($1.00) and
<br />other good and valuable consideration, the receipt of which is hereby acknowledged, does hereby grant, remise,
<br />convey and relinquish unto Northwestern Corporation, a Delaware Corporation, d/b/a Northwestern Energy, the
<br />"Grantee", of Huron, South Dakota, its successors or assigns, a gas utility easement for the installation, maintenance
<br />and operation of an underground natural gas pipeline along with all appurtenances thereto over, under, upon and
<br />through the following described lands situated in the county of Hall, the state of Nebraska, to wit:
<br />A tract of land located in part of the Southeast Quarter (SE114) of Section Three (3), Township
<br />Eleven North (T11N), Range Ten West (R10W) of the 60 Principal Meridian, Hall County,
<br />Nebraska, as illustrated in attached Exhibit "A", and more particularly described as follows:
<br />Commencing at the East Quarter (E114) Corner of said section; thence S89°28'38"W along the
<br />North Line of the Southeast Quarter (SE114), a distance of 33.00 feet to the Point of Beginning;
<br />thence S01°04'05"E, a distance of 25.00 feet; thence S89°28'38"W, a distance of 27.00 feet;
<br />thence N01°04'05"W, a distance of 25.00 feet to the North Line of the Southeast Quarter
<br />(SE114); thence N89°28'38"E along said North Line, a distance of 27.00 feet to the Point of
<br />Beginning. Said tract of land containing 0.015 acres, more or less.
<br />[The purpose of the above described easement is for an underground natural gas pipeline
<br />along with all appurtenances thereto (the "Facilities").]
<br />TO HAVE AND TO HOLD unto said Grantee, its successors and assigns, so long as such Facilities shall be
<br />maintained and operated, together with the right of ingress and egress from said premises for the purpose of
<br />surveying, constructing, installing, inspecting, repairing, maintaining, renewing and replacing the property of the
<br />Grantee located thereon, or removed thereof, in whole or in part, at the will of the Grantee.
