202006545 <br />The computation of the annual rent shall be done by the Lessor, but shall be uniform among all <br />Lessees -stockholders of Kuester Lake, Inc. In any event the annual rent of the Lessees shall not <br />exceed One Hundred Dollars ($100.00) unless a majority of all Lessees -stockholders of Kuester <br />Lake, Inc. (one vote for each share), present and voting at a special meeting called for that purpose, <br />shall approve the same. <br />6. Access. The Lessees shall have access from the leased premises onto the Lessor's roads <br />a d shall also have the right to use the lake for boating, swimming, and fishing. These access rights <br />in common with the other leaseholders at Kuester Lake. <br />6a. Prior Leases. This Lease replaces and supersedes any prior Lease for said premises <br />v,'hich the Lessees or his predecessors in title may have held. <br />7. Determination of Boundaries. The Lessor shall have the right, on a reasonable basis, to <br />determine the boundaries between the Lessees and his neighbors if the Lessees and his neighbors <br />Oannot agree to such boundary line. The lake front boundary of the leased premises shall be to the <br />bater line as the same may exist from time to time with changes in the water level of the lake. The <br />oundary line of the leased premises abutting the Lessor's common roads shall be reasonably <br />determined by the Lessor. <br />8. Peaceful Possession. As long as Lessees conforms with the requirements binding upon <br />them in this Lease Agreement, the Lessees shall enjoy peaceful possession of the leased premises. <br />9. Improvements. The Lessees shall keep the leased premises in a neat and clean <br />4ondition at all times and shall keep all improvements on the leased premises in a good condition of <br />repair. <br />10. Abandonment. The Lessees agrees not to abandon the leased premises. <br />11. Access for Installing Utility Lines. The Lessor reserves the right to come upon the <br />leased premises for installation of underground or above -ground utility lines and the making of <br />tecessary repairs or improvements to or abutting the leased premises. The Lessor agrees to restore <br />he premises to substantially the same condition as they were before any such installation and at the <br />Lessor's expense. <br />12. Access for Outlet Pipe. Lessor states that there is a 10" underground lake overflow <br />outlet pipe buried under the surface of the leased premises at the location shown on the map <br />ittached hereto as Exhibit "A". Lessees acknowledges that he is aware of the location of the buried <br />pipe. Lessees further acknowledges that the Lessor reserves the right to have unobstructed access to <br />the premises for the purpose of maintaining, repairing, replacing or removing the overflow outlet <br />Pipe. Lessees further acknowledges that he cannot build a structure over the space that the buried <br />pipe is located. This access right belongs to the Lessor and runs with the land and is binding upon <br />11 Lessees or other users of the premises. <br />13. Rules and Regulations. The Lessees agrees to comply with the rules and regulations as <br />repared and furnished by the Lessor to the Lessees, from time to time. Such rules and regulations <br />hall contain restrictions and limitations, for the mutual benefit of all Lessees at Kuester Lake, <br />pertaining to the use by the several Lessees at Kuester Lake of the lake itself, common roads, and <br />the leased premises. It is understood that the basic use of the leased premises shall be for residential <br />purposes, but the Lessor may permit, from time to time, commercial activities on the leased <br />premises. Any such rules, regulations and permits are subject to change by the Lessor, excepting <br />that the basic purpose of the leased premises as residential shall not be abridged. Any changes in <br />the rules and regulations must be approved by a majority of the leaseholders present and voting at a <br />meeting called for such purpose of which written notice has been given to all leaseholders (one vote <br />per Lease). <br />14. Occupancy and Use. Only dwellings intended for occupancy by one family may be <br />constructed upon the leased premises and occupancy by more than one family in any such dwelling <br />shall not be permitted. In no event shall the leased premises be utilized for any commercial or <br />business enterprise. <br />For the purposes of the restricted occupancy herein permitted, a "family" shall be defined as <br />persons related by blood, marriage or adoption, and any persons residing in a committed familial <br />2 <br />
