20200498q <br />CLOCKWISE DIRECTION HAVING A DELTA ANGLE OF 51°28'25", A RADIUS OF 270.00 FEET, A <br />CHORD BEARING OF N65°53'47"W, A CHORD DISTANCE OF 234.49 FEET, AN ARC LENGTH OF <br />242.56 FEET; THENCE S88°22'00"W A DISTANCE OF 144.66 FEET TO A POINT ON THE EAST LINE <br />OF SAID PROPOSED RIGHT-OF-WAY TRACT; THENCE NO 1 °38'00"W A DISTANCE OF 60.00 FEET <br />TO A POINT OF BEGINNING. SAID UTILITY/ACCESS EASEMENT CONTAINS 24,997 SF MORE OR <br />LESS. <br />As a result of the grant of this permanent public utility and access easement, the Grantee shall <br />have the following rights, namely: (a) unrestricted ingress and egress under, over, and across the <br />easement area for the purpose of exercising the rights herein granted; (b) the right to excavate and <br />refill ditches and trenches on the easement area; and (c) the right to construct, inspect, repair, replace, <br />remove, and maintain public utilities upon and under the easement area; and (d) the right to clear and <br />keep clear of structures, trees, roots, brush, hedges, undergrowth, and other obstructions from the <br />easement area that interferes with the location, construction, inspection, repair, replacement, <br />removal, and maintenance of such public utilities; provided, however, Grantee shall repair any <br />damage to any "Permitted Improvement" (as hereinafter defined) when exercising any of the Grantee <br />rights set forth above. Any such utility and appurtenances placed upon and under the easement <br />agreement shall remain the property of the Grantee and may be removed or replaced at any time. <br />Grantee acknowledges that no above ground utility lines or poles are permitted within the easement <br />area described above. <br />The Grantor, for itself, its heirs, executors, administrators, successors, and assigns, hereby <br />covenant that no buildings, fences, or structures shall be erected or permitted within the easement <br />area and that the easement herein granted shall run with the title to the easement area and be binding <br />upon the Grantor, its successors and assigns.
