202004924 <br />Subdivision as a dwelling at any time, nor shall any structure of a temporary nature be <br />used as a residence." <br />F. The owners of the requisite number of Lots desire to modify Section 3 of the Covenants <br />as hereinafter set forth. <br />NOW, THEREFORE, in consideration of this Amendment, the mutual covenants and agreements <br />herein contained and for other good and valuable consideration, the receipt and value and <br />sufficiency of which is hereby acknowledged, the parties hereto covenant and agree as follows: <br />1. Section 3 of the covenants is deleted in its entirety and the following is substituted <br />therefore: <br />No building or dwelling house shall be moved into the Subdivision <br />and placed upon any Lot except on Lot 5. Lot 5 may utilize a <br />modular home utilizing a special Eden floor plan (PID 4291) built <br />by BonnaVilla Homes, a division of Chief Industries fabricated in <br />Aurora, Nebraska, meeting all other sections of these restrictive <br />covenants and built on a permanent foundation in accordance with <br />Hall County building code and meeting requirements of local <br />building inspections. No mobile home shall be placed on any Lot. <br />No trailer, tent garage, shack, or other unsightly out -buildings shall <br />be used in the Subdivision as a dwelling at any time, nor shall any <br />structure of a temporary nature be used as a residence. <br />2. Reconfirm other Terms. All other terms and conditions of the Covenants are hereby <br />reconfirmed, except to the extent they expressly conflict with the terms of this <br />Amendment. <br />3. Defined Terms. All terms not otherwise defined herein shall have the meaning as set <br />forth in the Covenants. <br />4. Counterparts. This Amendment may be executed in two or more counterparts, all of <br />which shall, in the aggregate, be considered one and the same instrument. <br />[Signature and Notary Page Follows] <br />-2- <br />
