Koralewski and Jenda Barnes-Koralewski, husband and <br />wife, (collectively hereinafter: "Trustor"), whose address is 2618 Idaho Avenue, Grand Island, NE <br />68803; Luke T. Deaver (hereinafter: "Trustee"), attorney at law, whose address is 413 East <br />Avenue, P.O. Box 466, Holdrege, NE 68949; and Holdrege Irrigation, Inc., a Nebraska <br />Corporation, (hereinafter: "Beneficiary"), whose address is 2011 4th Avenue, Holdrege, NE 68949. <br />FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers, conveys and assigns <br />to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of Beneficiary, <br />under and subject to the terms and conditions of this Deed of Trust, the real property, located in <br />the State of Nebraska and described as follows: <br />Lot Three (3), Block One (1), Woodland Park Twelfth Subdivision, in the City <br />of Grand Island, Hall County, Nebraska. (hereinafter: "Trust Estate"). <br />TOGETHER WITH, all rents, easements, appurtenances, hereditaments, interests in <br />adjoining road, improvements and buildings of any kind situated thereon and all personal property <br />that may be or hereafter become an integral part of such buildings and improvements. <br />Trustor owes Beneficiary the principal sum of Forty -Nine Thousand Dollars ($47,700.00), <br />evidenced by Trustor's Promissory Note (hereinafter: "Note") payable in accordance with the terms <br />of the Note plus interest and other charges contained within the provisions of the Note along with <br />any and all modifications, extensions and renewals thereof. This Deed of Trust is a security <br />instrument and secures to Beneficiary the debt evidenced by the Note, the payment of all other <br />sums, with interest, advanced under the provisions hereafter to protect the security and the <br />performance of Trustor's covenants and agreement. Trustor covenants that Trustor is lawfully <br />seized of the property and have the legal power and lawful authority to convey the same and <br />warrant and will defend title to the property against the lawful claims of all persons. <br />
