202002679 ARTICLE 1 DEFINITIONS Unless otherwise defined, the following words and phrases when used in this Declaration, or in connection with this Declaration, shall have the meanings set forth in this Article 1. 1.1 "Additional Property" means any real property other than the "Initial Covered Property", together with all Improvements located thereon, that is subsequently included and subjected to this Declaration pursuant to Section 2.2. 1.2 "Areas of Association Responsibility" means (a) all Common Areas; and (b) all land, and the improvements situated thereon, located within the boundaries of a Lot or a public right-of-way which the Association is obligated to maintain, repair and replace pursuant to the terms of this Declaration, a Supplemental Declaration or other Recorded document executed by the Declarant or the Association. 1.3 "Articles" means the Articles of Incorporation of the Association, as amended from time to time. 1.4 "Assessable Lot" means a Lot owned by a Person other than the Declarant or a Designated Builder. 1.5 "Assessment" means a Regular Assessment, Special Assessment, Enforcement Assessment, or Subdivision Assessment. 1.6 "Assessment Lien" means the lien created and imposed by Section 8.9. 1.7 "Assessment Period" means the period set forth in Section 8.6. 1.8 "Association" shall mean and refer to Copper Creek Rodney Leon Community Association, Inc., a Nebraska nonprofit corporation, and its successors and assigns. 1.9 "Association Rules" means the rules adopted by the Board pursuant to Section 7.3. 1.10 "Board" means the Board of Directors of the Association 1.11 "Builder" means The Guarantee Group, L.L.C. and/or its assigns. 1.12 "By -Laws" means the By -Laws of the Association, as amended from time to time. 1.13 "Collection Costs" means all costs, fees, charges, and expenditures, including without limitation attorneys' fees (whether or not a legal action is filed), court costs, filing fees, and recording fees incurred by the Association in collecting and/or enforcing payment of Assessments, monetary penalties, late fees, demand fees, interest, or other amounts payable to the Association pursuant to this Declaration. 1.14 "Common Area" means that portion of the real property described herein and all other land, together with all Improvements situated thereon, that the Association owns in fee or in which the Association has a leasehold interest, for as long as the Association is the owner of the fee or leasehold interest, intended for common benefit and use of its Members. Common Area shall not include any Lot that the Association acquires by foreclosure of the Assessment Lien or deed in lieu of foreclosure. 1.15 "Common Expenses" means the actual and estimated expenses incurred or anticipated to be incurred by or on behalf of the Association, including any allocations to reserves determined by the Board to be necessary and appropriate, and all other financial liabilities of the Association. 1.16 "Community Documents" means, collectively, this Declaration, the Articles, the By- laws, the Association Rules, and the Design Guidelines, all as amended from time to time. 1.17 "County" means Hall County, Nebraska. 1.18 "Declarant" means The Guarantee Group L.L.C., a Nebraska Limited Liability Company, and any person to whom it may expressly assign any or all of its rights under this Declaration by Page 8 of 52
