202002679 <br />ARTICLE 1 <br />DEFINITIONS <br />Unless otherwise defined, the following words and phrases when used in this Declaration, <br />or in connection with this Declaration, shall have the meanings set forth in this Article 1. <br />1.1 "Additional Property" means any real property other than the "Initial Covered Property", <br />together with all Improvements located thereon, that is subsequently included and subjected to this <br />Declaration pursuant to Section 2.2. <br />1.2 "Areas of Association Responsibility" means (a) all Common Areas; and (b) all land, and <br />the improvements situated thereon, located within the boundaries of a Lot or a public right-of-way <br />which the Association is obligated to maintain, repair and replace pursuant to the terms of this <br />Declaration, a Supplemental Declaration or other Recorded document executed by the Declarant <br />or the Association. <br />1.3 "Articles" means the Articles of Incorporation of the Association, as amended from time <br />to time. <br />1.4 "Assessable Lot" means a Lot owned by a Person other than the Declarant or a Designated <br />Builder. <br />1.5 "Assessment" means a Regular Assessment, Special Assessment, Enforcement <br />Assessment, or Subdivision Assessment. <br />1.6 "Assessment Lien" means the lien created and imposed by Section 8.9. <br />1.7 "Assessment Period" means the period set forth in Section 8.6. <br />1.8 "Association" shall mean and refer to Copper Creek Rodney Leon Community <br />Association, Inc., a Nebraska nonprofit corporation, and its successors and assigns. <br />1.9 "Association Rules" means the rules adopted by the Board pursuant to Section 7.3. <br />1.10 "Board" means the Board of Directors of the Association <br />1.11 "Builder" means The Guarantee Group, L.L.C. and/or its assigns. <br />1.12 "By -Laws" means the By -Laws of the Association, as amended from time to time. <br />1.13 "Collection Costs" means all costs, fees, charges, and expenditures, including without <br />limitation attorneys' fees (whether or not a legal action is filed), court costs, filing fees, and <br />recording fees incurred by the Association in collecting and/or enforcing payment of Assessments, <br />monetary penalties, late fees, demand fees, interest, or other amounts payable to the Association <br />pursuant to this Declaration. <br />1.14 "Common Area" means that portion of the real property described herein and all other <br />land, together with all Improvements situated thereon, that the Association owns in fee or in which <br />the Association has a leasehold interest, for as long as the Association is the owner of the fee or <br />leasehold interest, intended for common benefit and use of its Members. Common Area shall not <br />include any Lot that the Association acquires by foreclosure of the Assessment Lien or deed in <br />lieu of foreclosure. <br />1.15 "Common Expenses" means the actual and estimated expenses incurred or anticipated to <br />be incurred by or on behalf of the Association, including any allocations to reserves determined <br />by the Board to be necessary and appropriate, and all other financial liabilities of the Association. <br />1.16 "Community Documents" means, collectively, this Declaration, the Articles, the By- <br />laws, the Association Rules, and the Design Guidelines, all as amended from time to time. <br />1.17 "County" means Hall County, Nebraska. <br />1.18 "Declarant" means The Guarantee Group L.L.C., a Nebraska Limited Liability Company, <br />and any person to whom it may expressly assign any or all of its rights under this Declaration by <br />Page 8 of 52 <br />
