202002679 <br />4.21 Screening Materials. <br />All screening materials, whether fences, hedges, or walls, on the Lots shall be maintained <br />and replaced from time to time by the Owners thereof in accordance with the original construction <br />of such Improvements by the Declarant or a Designated Builder or as approved by the DRC <br />pursuant to Article 3. <br />4.22 Lights. <br />Except as initially installed by the Declarant or a Designated Builder, no spotlights, <br />floodlights, or other high-intensity lighting shall be placed or utilized upon any Lot that in any <br />manner will allow light to be directed or reflected on any other property, except as approved by <br />the DRC. <br />4.23 Window Cover Materials. <br />Permanent draperies or suitable window treatments shall be installed on all front -facing <br />windows within sixty (60) days of occupancy. No reflective materials with a reflectivity greater <br />than 20%, including but not limited to aluminum foil, reflective screens or glass, mirrors, or similar <br />type material, shall be installed or place upon the inside of any windows. <br />4.24 Maintenance; Landscaping. <br />Maintenance, upkeep, and repairs of any Residence or other Improvements on each Lot <br />shall be the sole responsibility of the Owner thereof and shall be kept and maintained in a clean <br />and first-class condition and state of repair. All water and sewer lines, pipes, equipment, and <br />connections installed within and servicing any Lot shall be maintained and kept in repair by the <br />Lot Owner. All gas and electric pipes, conduits, equipment, and connections installed within and <br />servicing any Lot shall be maintained and kept in repair by the Lot Owner commencing at the point <br />where the gas and electric pipes, conduits, equipment, and connections are connected to the <br />metering device for the Lot installed by the respective gas or electric company. <br />All landscaping shall be aesthetically pleasing and reasonably consistent with the <br />landscaping of the surrounding Lots. Weather permitting, all Lots shall be reasonably landscaped <br />as soon as possible after a Residence is built on the Lot but in no event more than three (3) months <br />after such Residence is built. All landscaping shall be in accordance with any requirements of the <br />DRC and shall be subject to approval of the DRC. All such landscaping shall be fertilized, watered, <br />and trimmed so as to maintain a first-class, healthy, and attractive appearance. Shrubs, trees, or <br />similar items shall be erected or maintained in a manner that will not obstruct traffic vision. <br />Plantings (excepting grass) and decorative items shall not be placed within five feet (5') of the <br />curb or any adjacent Residence or related Improvements. Lawns shall be mowed, fertilized, <br />watered, and edged to maintain a first-class, healthy, and attractive appearance. All grass and <br />weeds shall be cleaned out of cracks in sidewalks, patios, and driveways. <br />All residential plantings must come from the approved plant palette for the Property, which <br />plantings were selected to maintain consistency in the community character while allowing <br />sufficient diversity in residential planting themes. A list of the pre -approved plantings is contained <br />in the Minimum Planting Requirements hereafter set forth. <br />All landscaping shall be maintained in accordance with reasonable standards established <br />by the DRC. All landscape plants shall be maintained by a fully -automatic underground watering <br />system, and care should be taken to avoid over -spray on hardscape, structures, windows, and <br />adjoining properties. The use of metal edging or borders between planting areas or lot lines is <br />prohibited. The use of solid plastic sheeting or polyethylene over ground areas will not be <br />permitted. If landscape fabric is used, it must allow the free flow of air, water, and gases to and <br />from the soil. Comparable materials may be used only with prior approval of the DRC. All <br />mounds and/or berms shall be no higher than thirty-six inches (36") and shall not alter the original <br />drainage pattern of the Lot. <br />All Landscaping plans or amendments to an approved landscaping plan must be submitted <br />to the DRC in accordance with the instructions set forth on Exhibit A to this Declaration. <br />Page 24 of 52 <br />
