202002679 <br />within the time period presented in this Section, the DRC may revoke its approval of the <br />Construction or Modification. <br />3.6 No Changes Without Approval. <br />Any Construction or Modification approved by the DRC must be done or performed in <br />accordance with the plans and specifications approved by the DRC. No change, deletion, or <br />addition to the approved plans and specifications may be made without the prior written approval <br />of the DRC. In the event of damage to or destruction of any Improvement on any Lot, the Owner <br />thereof shall, subject to the approval of the DRC, either: (i) cause the damaged or destroyed <br />Improvement to be replaced or restored to its original condition or such other condition as may be <br />approved in writing by the DRC or (ii) the Owner shall cause the damaged or destroyed <br />Improvement to be demolished and the Lot to be suitably landscaped, so as to present a pleasing <br />and attractive appearance. <br />3.7 Review Fee. <br />The DRC shall have the right to charge a fee for reviewing requests for approval of any <br />Construction or Modification, which fee shall be payable at the time the application for approval <br />is submitted to the DRC. The fee charge by the DRC may include the actual or estimated fees or <br />costs incurred or anticipated to be incurred by the DRC in consulting with, or having the <br />application reviewed by, architects, engineers, or other professionals. The Association may retain <br />architects, engineers or other professionals as deemed necessary to review applications or <br />otherwise assist the DRC. <br />3.8 New Construction. <br />All Improvements constructed on Lots shall be of new construction, and no buildings or <br />other structures shall be removed from other locations on to any Lot. The following architectural <br />standards have been adopted by the Declarant: (a) Home Size. Homes shall contain a minimum <br />square footage, exclusive of other accessory structures, of 1,100 square feet of fully -enclosed <br />living area on the main level. (b) Roof Pitch. The roof pitch for homes shall be at least a 4/12 <br />pitch. (c) Roofing Material. The roof material shall be of at least 30 -year architectural asphalt <br />shingles. The roof shall be a color to compliment the Residence as determined by the DRC. (d) <br />Home Siding. The siding of the Residence and any ancillary buildings shall be of cement board <br />material, with a maximum exposure of 8 inches of LAP, with both the Residence and ancillary <br />buildings matching in color. <br />3.9 No Warranty. <br />The approval by the DRC of any Construction or Modification shall not be deemed a <br />warranty or representation by the DRC as to the quality of such Construction or Modification or <br />that such Construction or Modification conforms to any applicable building codes or other federal, <br />state, or local law, statute, ordinance, rule, or regulation. The DRC shall not be liable or bear any <br />responsibility for (a) ensuring the structural integrity, quality, soundness, or workmanship of any <br />Construction or Modification approved by the DRC, (b) ensuring compliance with building codes <br />or other governmental requirements, or (c) ensuring that all Improvements are of comparable <br />quality, value, size, or structural integrity. <br />3.10 Conditional Approval. <br />The DRC may condition its approval of plans and specifications upon the agreement by <br />the Owner submitting such plans and specifications to furnish to the Association a bond or other <br />security acceptable to the DRC in an amount determined by the DRC to be reasonable sufficient <br />to (a) assure the completion of the proposed Construction or Modification, or the availability of <br />funds adequate to remedy any nuisance or unsightly conditions occurring as a result of the partial <br />completion of such Construction or Modification, and (b) repair any damage that might be caused <br />to any Area of Association Responsibility as a result of such work. Provided there is no damage <br />caused to any Area of Association Responsibility by the Owner or its agents or contractors, any <br />such bond shall be released or security shall be fully refundable to the Owner upon the completion <br />of the Construction or Modification in accordance with the plans and specifications approved by <br />the DRC and upon the Owner's written request to the DRC. <br />Page 15 of 52 <br />
