202002679 <br />interest of a Lot. Owner shall not include Persons having an interest in a Lot merely as security <br />for the performance of an obligation. Owner shall include a Purchaser under a Recorded contract <br />for the conveyance of real property subject to the provisions of Nebraska real estate law. Owner <br />shall not include a Purchaser under an unrecorded purchase contract and receipt, escrow <br />instruction, or similar executory contract intended to control the rights and obligations of the <br />parties to the executory contract pending the closing of a sale or purchase transaction. In the case <br />of a Lot subject to a deed of trust pursuant to Nebraska Statutes, the trustor shall be deemed to be <br />the Owner. In the case of a Lot to which fee simple title is vested in a trustee pursuant to a <br />subdivision trust agreement or similar agreement, the beneficiary of any such trust who is entitled <br />to possession of the trust property shall be deemed to be the Owner. <br />1.35 "Person" means a natural person, corporation, business trust, estate, trust, partnership, <br />association, limited liability company, joint venture, government, governmental subdivision or <br />agency, or other legal or commercial entity. <br />1.36 "Plat" means (a) the initial subdivision and all additional subdivisions intended to be part <br />of the Copper Creek Rodney Leon Subdivision, and all amendments, supplements, and corrections <br />thereto; and (b) any plat Recorded against any part of the Additional Property that is subsequently <br />included and subjected to this Declaration pursuant to Section 2.2, and all amendments, <br />supplements, and corrections thereto. <br />1.37 "Property" or "Pro Iect" means the Initial Covered Property and all portions of the <br />Additional Property that are subsequently included and subjected to this Declaration pursuant to <br />Section 2.2. <br />1.38 "Purchaser" means any Person, other than the Declarant, who becomes the Owner of a <br />Lot by means of a voluntary transfer, except for (a) a Person who purchases a Lot and then leases <br />it to the Declarant for use as a model in connection with the sale of other Lots; (b) a Person who, <br />in addition to purchasing a Lot, is assigned any or all of the Declarant's rights under this <br />Declaration; or (c) a Designated Builder. <br />1.39 "Recording" or "Record" means placing an instrument of public record in the office <br />maintained for recording documents affecting real property in Hall County, Nebraska, and <br />"Recorded" means having been so placed of public record. <br />1.40 "Regular Assessment" means an assessment levied pursuant to Section 8.2. <br />1.41 "Residence" means any building or portion of a building situated upon a Lot and designed <br />and intended for independent ownership and for use and occupancy as a residence. <br />1.42 "Resident" means each person occupying or residing in any Residence. <br />1.43 "Special Assessment" means any assessment levied pursuant to Section 8.3. <br />1.44 "Subdivision Assessment" means any assessment levied pursuant to Section 8.4. <br />1.45 "Subdivision Assessment Area" means a portion of the Project designated in a <br />Supplemental Declaration as an area containing Subdivision Common Areas or as an area in which <br />the Association will provide Subdivision Services. <br />1.46 "Subdivision Common Area" means any part of the Common Area that is designated in <br />a Supplemental Declaration as being for the sole or primary benefit of the Owners and Residents <br />of a particular part of the Project. Subdivision Common Areas may include, without limitation, <br />drainage or retention areas, landscape medians, and areas designated as parks. <br />1.47 "Subdivision Expenses" means the actual or estimated expenses, including allocations to <br />reserves. incurred or anticipated to be incurred by the Association for the maintenance, repair, and <br />replacement of Subdivision Common Areas or to provide Subdivision Services to the Owners and <br />Residents in a Subdivision Assessment Area. <br />1.48 "Subdivision Services" means services designated in a Supplemental Declaration as being <br />for the sole or primary benefit of the Owners and Residents of a particular part of the Project. <br />Subdivision Services may include, without limitation, landscape maintenance services for <br />landscaping situated on a Subdivision Common Area. <br />Page 10 of 52 <br />
