200108680 DEED OF TRUST This Deed of Trust is made this 28th day of August, 2001, by and among Doug C. Luth and Sherri L. Luth, hereinafter referred to as Trustor, whether one or more, whose mailing address is 4312 North 90 Road, Cairo, Hall County, Nebraska, 68824; James A. Wagoner, hereinafter referred to as Trustee, whose mailing address is Post Office Box 1585, Grand Island, Hall County, Nebraska, 68802; and Jack Gosda and Ann Gosda, hereinafter referred to as Beneficiary, whether one or more, whose mailing address is 4030 Palace Drive, Grand Island, Hall County, Nebraska, 68803. For valuable consideration, Trustor irrevocably grants, transfers, conveys and assigns to Trustee, in trust, with power of sale, for the benefit and security of Beneficiary under and subject to the terms and conditions of this Deed of Trust, the following - described property: Lots Two (2) and Four (4) in Block One (1) in College Addition to West Lawn, an Addition to the City of Grand Island, in Hall County, Nebraska. FOR THE PURPOSE OF SECURING: (a) The payment of indebtedness evidenced by Trustor's Note of even date herewith in the principal sum of ONE HUNDRED THIRTY FIVE THOUSAND AND NO /100 DOLLARS ($135,000.00), together with interest at the rate provided herein, both principal and interest on the Notes being payable in accordance with the terms set forth therein, which by this reference is hereby made a part hereof. (b) The performance of each agreement and covenant of Trustor herein contained; and, (c) The payment of any sum or sums of money which may be hereafter paid or advanced by Beneficiary under the terms of this Deed of Trust, together with interest thereon at the rate provided in the Note.
