HOLSMAN <br />Commissioner 573-751-3234 Commissioner <br />573-751-1847 (Fax Number) <br />http://psc.mo.gov <br />March 24, 2020 <br />To Whom It May Concern: <br />Recently the Commission has been contacted by several utilities and other parties who have <br />explained that due to social distancing resulting from the response to the COVID-19 pandemic they <br />have had difficulty obtaining in person notarized sworn statements required to be filed with certain <br />documents at the Commission. <br />To deal with this obstacle the Commission will look to section 509.030 of the Missouri statutes. <br />That section provides that "[ajny statutory requirement that pleadings be acknowledged under oath, <br />verified or notarized may be satisfied by a declaration that the pleading is made under penalty of <br />perjury." The Commission accepts that an affidavit that satisfies these statutory requirements would <br />also satisfy the requirements of the Commission's regulations. Therefore, any person may file an <br />affidavit in any matter before the Commission without being notarized so long as the affidavit contains <br />the following declaration: <br />"Under penalty of perjury, I declare that the foregoing is true an <br />the best of my knowledge and belief " <br />Li i 5 (7620 <br />This guidance applies both to pleadings filed in cases before the Commission and to required <br />annual reports and statements of income. <br />Sincerely, <br />Morris L.
