<br />hereinafter known as the Grantor, whether one or more, for and in
<br />consideration of the sum of f' o DOLLARS in hand
<br />paid does hereby grant and co vey unto CENTRAL PLATTE NATURAL RESOURCES
<br />DISTRICT hereinafter known as the Grantee and to its successors and assigns
<br />a perpetual and assignable right and easement in the land described below
<br />and incorporated herein by reference (hereinafter referred to as the
<br />"Habitat Easement Area ") Pursuant to the Habitat Easement and subject to
<br />reserved rights of the Grantor hereinafter expressed:
<br />The Grantee shall have the permanent and exclusive rights to:
<br />a) design, construct, operate, maintain, repair, reconstruct, revise,
<br />relocate and replace channels, side channels, sloughs, diversions,
<br />pools, basins, wetlands, wells, siphons, gravel beds, cobbles,
<br />boulders, pipes and other temporary and permanent devices, works,
<br />structures, improvements and features (hereinafter referred to as
<br />"the Habitat Improvements ") in the Habitat Easement Area as the
<br />Grantee in its sole discretion determines desirable for fish and
<br />wildlife enhancement;
<br />b) direct, redirect, increase, attenuate, adjust, affect or control
<br />the volume and flow of water, flood water, and sediment within
<br />and through and Habitat Easement Area;
<br />c) establish, eradicate, control and harvest vegetation, animals,
<br />fish and other flora annd fauan in the Habitat Easement Area;
<br />d) dredge, excavate, mine, borrow and fill in the Habitat Easement
<br />Area; and
<br />e) take such other actions in the Habitat Easement Area as the
<br />Grantee feels necessary;
<br />subject, however, to existing easements for public roads and highways,
<br />public utilities, railroads and pipelines, situated in Hall County, and
<br />State of Nebraska, to wit;

<br />public utilities, railroads and pipelines, situated in Hall County, and
<br />State of Nebraska, to wit;
