<br /> 14. Governing Iawi Severability. This Sccurity Instrument shall be govemed by Federal luw and the law of
<br /> the jurisdiction in which the Prc►perty is located. In the event that any provision or clause of this Securi[y lnstrument
<br /> or the Note conflicts with applicable law, such conflict shall not affect other provisions of this Security Instrum�nt or
<br /> the Nate which can be given effect without the confliccing provision. To this end the provisions of this Security
<br /> Instrument and the Note aze dxlared to be severable.
<br /> 15. Borrower's Copy. Borroa+er shall be given one conformed copy of the Note and of this Security
<br /> Instrument.
<br /> 16. HxzRrdnus Substances. Borrower shall not cause or permit the presence, use, disposal, stocage,or release
<br /> of any Hazardous Substances on or in the Property. Bottower shall not do,ndr allow anyane else ta do, anything
<br /> affecting thc Property that is in violation of any Environmental Lav�. The preceding two sentences shall not apply to
<br /> the presenct, use, or storage on the Property of small qu�ntities of Hazardous 5ubstances [hat are gencrally
<br /> recogniud to be appropriate to normal residential uses and to maintenance of the Property.
<br /> Bonower shall promptly give Lender writ?en notice of any investigation,claim,demand,lawsuit or other action
<br /> by any gavernmental or regulatory agency or priva[e party invalving the Property and any Hazardous Substance or
<br /> Environmental l.aw of which Borrower has astual knowledge. If Borrower leams,or is notified by any qovernmental
<br /> or regulatory authority, that a��y remuval or other remedietion of any Hazardous Substances affecting the Property is —
<br /> necessary,Borrower shall promptly take all necessary remedial actions in accordance with Environmental I.aw.
<br />- As used in this paragraph 16, "Hazardous Substances" are those substances defined as toxic or hazardous
<br /> substances by Environmental Law and the followin.g substances: gasoline, kerosene., other flammable or tvxic
<br /> petroleum products, toxic pesticicles and herbicides,valatile solvents, materials cuntaining asbestos or formaldehyde,
<br /> �,�.�q��rzyP macerials. As used in this paragraph 16, "Environrnental iaw" means federal laws and laws of the
<br /> jurisdiction where the Property is located that relate to health,safety or environmemai pcoir,�:iio�i.
<br /> - NON-UNIFORM COVBNANTS.Borrower and Lender further covenant and agree as follows:
<br /> _ 17, Assigament o[Rents. Borrower unconditionally assigns and transf�rs to Lender all the rents and revenues
<br /> of the Property.Barrower authori�tis ixnd�r or Lender's agents to collect the rents and revenues and hereby directs
<br /> each tenant of the Property [o pay thc rents to Lender or Lender's agents. However, prior to Leuder's notice to
<br /> Borrower of Borcower's brexh of any covenant or agreement in the Security Instrument,�3orrower shall collcet and
<br /> roceiva all rents and revenues of the Propecty as trustee for the benefit of Lender and aorrower. This acsignment of
<br /> rents constitutes an absolute assignmen[and not an assignment for additiona!security only.
<br /> If Lender gives notice of breach to Bortower: (a)a11 rents received by F3orrower shall be held by Bonower as
<br /> trustee for benefit of Lender only,to be applied to the sums secured by the Security Instrument; (b) Lender shall be
<br /> entitled to coltat and receive all of ihe rents of the Property; and(c) each tenant of the Property shall pay all nnts
<br /> due and unpaid to Lender or l,ender's agent on Lender's written demand to the[enant.
<br /> Borrower has not executed any prior assignment of the rents and has not and will not perform any act that would
<br /> prevent I.ender from exercisiug i[s rights under this paragraph 17.
<br /> Lender shall not be rcyuired to enter upon, take control of or maintain the Property before or after giving notice
<br /> of breach to BoROwer. Howeve;,i.:.nu�;os a;u�icially apgointed receiver may do so at any time thete is a breach.
<br /> Any application of rents shall not cure ot waive any default or invalidate any other right or remedy �f Lender. This
<br /> assignment of rents of the Prupeny shall terminate when the debt secured by the Security Instrument is paid in full.
