r <br />A <br />MORTGAGE ADDENDUM 89- 104704 <br />The following arc addenda to the Mortgage. Please check the applicable addendum. The addendum checked shall be Incorporated into, <br />and renordod with, the Mortgage. The term `Mortgage' shall be deemed to include 'Deed of Trust,' it applicable. <br />XX FHA ADDENDUM <br />As long as tha lillortgage is held by the Nebraska Investment Finance Authority, the Lender may declare all sums secured by the Mortgage <br />to be iminvdat0i dt:e and payable it <br />(a) all or part of the property is sold or otherwise transferred (other than by devise, descent or operation of law) by Borrower to a <br />purchaser or other transferee: <br />(i) who carom reasonably be expected to occupy the property as a principal residence within a reasonable time after the <br />sale or transfer, all as provided in Section 103A(d) and (j}(2) of the Internal Revenue Code; or <br />(ii) who has had a present ownership interest in a principal residence during a3iny part of the three-year period ending on the <br />date of the sale or transfer, afl;g!sprovided in Section 103(A}(e) and OX21 of the Internal Revenue Code (except that the <br />language - 10(3%- shall be substituted for "90% or more" where the latter appears in Section 103A(e)(1); or <br />(iii) at an acquisition cost which is greater than 110% of the average area purchase price (greater than 120% for targeted area <br />residences), all as provided in Section 103A(f) and (jx2) of the Internal Revenue Code: or ' . - <br />(iv) who has an income in excess of that established bythe Nebraska Investment Finance Authority under its applicable reguta, <br />tions or program guidelines In effect on the date of the sale or transfer, or <br />(b) Borrower fails to occupy the property described in the Mortgage without Lender's prior written consent: or <br />(c) Borrower omits or misrepresents a material fact in an appNcation for,the Mortgage. <br />References are to the Internal Revenue Code in effect on the date of execution of the mortgage and are deemep.to inchMs Iii$ implemen- <br />ting regulations. <br />VA MORTGAGE ADDENDUM <br />If, so long as the Mortgage is. held by the Nebraska Investment Finance Authority. all or apy.,part of the property is soitl or transferred <br />by Borrower without Lenders prior written consent, other than a transfer by deviser, descent.o{ by operatidn,ot law, the Lender may, at <br />Lender's option, declare all the sums secured by the Mortgage to be immediately due and payable. <br />CONVENTIONAL MORTGAGE A13DENDUM <br />As long as the Mortgage is held by they Nebraska Investment Finance Authority. the Lender may, at Lenders option, declare all sums <br />secured by the Mortgage to bo fmi: ediateiy due and payable if Borrower omits or mi &represents a fact in an application for the Mortgage, <br />including, without Iimitatiori,,HYSpi ?ing contained in the Mortgagors Affidavit anr!
