20200114 RESOLUTION NO.26 L WHEREAS, pursuant to the authority under the Village Code as adopted by the Village of Doniphan, Hall County, Nebraska, directives and billing statements were sent to the property owner of 302 N. Church St., legally described as: Lots One (1), Two (2) and Three (3), Block One (1) in Burger's Addition to the Village of Doniphan, Hall County, Nebraska, namely, Debbie Brunner, pertaining to vegetation maintenance in accordance with Section 94.03 of the Municipal Code; and WHEREAS, said individual who received such notice did not comply with the mowing of such vegetation and services were required to be performed by the Village to maintain such vegetation in accordance with Municipal Code and invoiced by billing statements dated August 14, 2018, August 17, 2018, October 10, 2018, May 17, 2019, June 6, 2019, June 25, 2019, July 23, 2019, August 29, 2019, and October 11, 2019; and WHEREAS, billing statements were properly submitted to the owner of said property who has failed or refused to make full payment thereunder and there remains due and owing for such services the sum of one Thousand Two Hundred Forty Dollars ($1,240.00); and WHEREAS, following a public hearing held on the /Z) day of I 9 ru c' - 20 Z' , it was determined that the fair and reasonable cost of assessing for mowing to said vegetation upon said property came to the amount of One Thousand Two Hundred Forty Dollars ($1,240.00) NOW, THEREFORE BE IT RESOLVED AS FOLLOWS: 1. The cost of vegetation maintenance to the real estate legally described as Lots One (1), Two (2) and Three (3), Block One (1) in Burger's Addition to the Village of Doniphan, Hall County, Nebraska should be and hereby are assessed as a special tax against said real estate payable as a single installment in the amount of One Thousand Two Hundred Forty Dollars ($1,240.00) as the result of the owner of said property failing to make payment on said amount, and that such amount shall bear interest at the legal rate following assessment. 2. The Village Clerk is hereby directed to send a certified copy of this resolution to the Hall County Treasurer for purposes of collecting such special assessment in accordance with all such special assessments levied by Municipal authorities.
