Rust and Theresa L. Rust, husband and wife, and Virginia M. Rust and <br />Steven M. Rust, wife and husband, (the "Declarants"). <br />ry <br />r r) <br />w <br />F-4 <br />W <br />=3 <br />F-� <br />RECITALS <br />WHEREAS, Declarants own the property legally described as Lot Sixteen (16), in Ross <br />Theasmeyer Subdivision, to the City of Grand Island, Hall County, Nebraska (the "Declarants' <br />Property"); and <br />WHEREAS, the Declarants' Property contains a row of trees in the southwestern portion <br />(the "Tree Line"); and <br />WHEREAS, Stacey Rust and Theresa Rust, Husband and Wife, own the property legally <br />described as Lot Nine (9), Block One (1), Woodland Park Thirteenth Subdivision, in the City of <br />Grand Island, Hall County, Nebraska (the "Protected Property"); and <br />WHEREAS, the Protected Property is situated directly south of the Declarants' Property; <br />and <br />WHEREAS, the Declarants wish to maintain the Tree Line for the privacy of the <br />Protected Property; <br />NOW, THEREFORE, in consideration of the foregoing and in consideration of the <br />covenant herein contained, Declarants do hereby declare and covenant as follows: <br />1. Declarants, and Declarants' grantees, successors in interest and assigns shall at all <br />times maintain the Tree Line in a condition substantially similar to the condition of the Tree Line <br />on the date of signature of this Declaration of Restrictive Covenant, including but not limited to <br />the replacement of trees as may from time -to -time be necessary. <br />2. This Declaration shall remain in full force and effect until such time as: <br />(a) The owners of the Protected Property terminate the Declaration of Restrictive <br />Covenant through written instrument; or <br />(b) Neither Stacy Rust nor Theresa Rust are an owner of the Protected Property. <br />5. This Declaration of Restrictive Covenant is binding upon the parties hereto, their <br />grantees, successors in interest and assigns and shall run with the land unless terminated as <br />permitted by this Declaration. <br />6. This Declaration of Restrictive Covenant shall be construed in accordance with <br />the laws of the State of Nebraska. <br />
