20200098/ <br />drainage from all lots, according to the drainage plan, so that storm drainage is conveyed to a public <br />right-of-way or to other drainage systems so approved by the Director of Public Works. If the <br />Subdivider fails to grade and maintain such drainage the City may create a drainage district to perform <br />such work. The Subdivider agrees to waive the right to object to the creation of any drainage district <br />benefitting the subdivision. <br />6. Detention Cell Easement Reserved. The subdivision is subject to that <br />certain reservation of easement of the City of Grand Island, Nebraska, for storm water encroachment <br />and for maintenance, repair, and operation of the "Brach's Lake" detention cell upon a tract of land <br />located in the Northwest Quarter of the Southwest Quarter (NE1/4 SW1/4) of Section Twenty-one <br />(21), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, and <br />more particularly described as follows: <br />Lot 10A and Lot 11A of Lake Front Tracts Abutting Brach's Lake shown on the City <br />of Grand Island Engineering Department Plat identified as "Brach's Lake", dated 9- <br />29-72, drawn by T.W.B., and attached to quitclaim deed recorded in Book 104-B of <br />Deeds at Page 23 in the Register of Deeds office, Hall County, Nebraska. <br />Subdivider may construct and maintain earthen berms and structures for the prevention of shoreline <br />erosion within said reserved easement located within the subdivision boundary. <br />7. Sidewalks. The Subdivider shall maintain all public sidewalks required by the <br />City of Grand Island. <br />8. Easements. Any easements shall be kept free of obstructions and the Subdivider <br />shall indemnify the City for any removal or repair costs caused by any obstructions. In addition, the duty <br />to maintain the surface of any easements to keep them clear of any worthless vegetation or nuisance shall <br />run with the land. <br />Subdivision Agreement Brach's Seventh Subdivision <br />-3 <br />
