Wheeler Avenue, Grand Island, Nebraska. <br />Understand that: <br />(a) The document to be executed is a Deed of Trust and not a Mortgage; and <br />(b) The power of sale provided for in the Deed of Trust provides substantially different rights and <br />obligations to the Trustor than a Mortgage in the event of default or breach of obligations. <br />DISCLAIMER\WAIVER <br />In accordance with the provisions of the Nebraska Farm Homestead Protection Act (Section 76-1901 <br />R.R.S. 1943 et. seq.), the undersigned Trustor in the attached Deed of Trust represents and states as indicated <br />preceding their initials: <br />1. Non -Occupied Real Estate. No part of the homestead of the Trustor is presently or in the future <br />will be situated upon the real estate described in the Deed of Trust, and the Trustor understands <br />that if the Trustor signs this Disclaimer\Waiver and subsequently establishes a homestead on any <br />part of the real estate described in the Deed of Trust during the time the Deed of Trust remains <br />unsatisfied and a lien upon the real estate described in the Deed of Trust, Trustor shall have no <br />right to make a designation of homestead in the event of a Trustee's Sale pursuant to the terms of <br />the Deed of Trust. <br />2. Occupied Real Estate.
