Huntley, General Partner of The Merle Family Limited Partnership, a <br />Colorado Limited Partnership being first duly sworn upon oath, depose and state that <br />he knows of his own personal knowledge: <br />The Merle Family Limited Partnership is the owner of record and present title holder <br />in fee simple of the real estate legally described as: <br />A tract of land in the Northeast Quarter of the Northeast Quarter (NE1/4NE1/4) of Section Fifteen (15), <br />Township Eleven (11) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska more <br />particularly described as follows: <br />Beginning at the Southeast corner of Sharon Rose Subdivision in Grand Island, Nebraska; thence <br />S89°39'09"W (on an assumed bearing and all bearings contained herein, are relative thereto;) on the <br />South line of Sharon Rose Subdivision a distance of 100 feet to the Southwest corner of said Subdivision; <br />thence S00°59'47"E on the West line of Sharon Rose Subdivision if extended South a distance of 268.07 <br />feet to the Northerly right-of-way line of US Hwy 30; thence N63°31'46"E on said right-of-way a distance <br />of 110.75 feet to the West line of Willow Street; thence N00°56'48"W on the West line of said Street a <br />distance of 219.50 feet to the point of beginning. <br />That they are in either actual or constructive possession of said real estate and <br />the whole thereof, and that the immediate and remote grantors have a continuous and <br />unbroken record chain of title to such real estate and the whole thereof, for a period of <br />more than Twenty -Three (23) years last past, and that during that time title to said <br />premises has never been disputed. <br />That they made this affidavit pursuant to the provisions of the Nebraska <br />"Marketable Title Act", being Section 76-288 to Section 76-298 inclusive, of the revised <br />Statutes of Nebraska, for 1943, reissue of 1986. <br />Further affiant saith not. <br />By Frank W.
