Lindquist, a member of the <br />Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a power of sale <br />contained in that certain Deed of Trust recorded on May 20, 2004 as Instrument No. 0200405042 in the Office of <br />the Register of Deeds of Hall County, Nebraska, and Jay Lee, a married man, hereinafter called "Grantee". <br />WHEREAS, on October 22, 2019, Grantor, executed a Notice of Default pursuant to which notice was <br />given to Wayne E. Norden and Lenora M. Norden, husband and wife, Trustors, under that certain Deed of Trust <br />recorded on May 20, 2004 as Instrument No. 0200405042 in the Office of the Register of Deeds of Hall County, <br />Nebraska, covering that certain premises described as: <br />A tract of land comprising a part of Lot Four (4), Wilson's Subdivision, situated in the Southwest <br />Quarter (SW 1/4) of Section Three (3), Township Eleven (11) North, Range Nine (9), West of the <br />6th P.M., in Hall County, Nebraska; more particularly described as follows: Beginning at a point on <br />the Easterly right-of-way line of the Burlington Northern Railroad, said point being Thirty-three and <br />Three Hundredths (33.03) feet North of the South line of Section Three (3); thence Northerly along <br />said Railroad right-of-way line, a distance of One Hundred Eight and Twelve Hundredths (108.12) <br />feet; thence Easterly parallel to the South line of said Section Three (3); a distance of One Hundred <br />Two and Fifty-six Hundredths (102.56) feet; thence deflecting right 89°44'30" and running <br />Southerly a distance of One Hundred Eight (108.0) feet, to a point Thirty-three (33.0) feet North of <br />the South line of said Section Three (3); thence Westerly parallel to the South line of said Section <br />Three (3), a distance of Ninety-eight (98.0) feet to the place of beginning; AND a tract of land <br />comprising part of Lot Four (4), Wilson's Subdivision, in part of the Southeast Quarter of the <br />Southwest Quarter (SE 1/4 SW 1/4) of Section Three (3), Township Eleven (11) North, Range Nine <br />(9) West of the 6th P.M., Hall County, Nebraska, more particularly described as follows: Beginning <br />at the Southwest corner of said Lot Four (4), also being a point on the Easterly right-of-way line, of <br />the Union Pacific Railroad; thence Northerly along said right-of-way line, a distance of Thirty-three <br />and Three Hundredths (33.03) feet, thence Easterly parallel to the South line of said Section Three <br />(3), a distance of Ninety-eight (98.0) feet; thence deflecting right 90°; thence Southerly parallel to <br />said railroad right-of-way line, a distance of Thirty-three and Three Hundredths (33.03) feet to the <br />South line of Section Three (3); thence Westerly along South line of Section Three (3), a distance of <br />Ninety-eight (98.0) feet to the place of beginning, <br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting forth the nature <br />of such breach and of his election to sell or cause to be sold such property to satisfy the obligation. Said Notice <br />of Default was filed for record in the Office of the Register of Deeds of Hall County, Nebraska, on October 23, <br />2019, as Instrument No. 201906596. <br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice pursuant to said <br />Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008. <br />Subsequent thereto, beginning on November 28, 2019, Grantor caused to be published in The Grand <br />Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a Notice of Trustee's <br />Sale setting forth a description of the property to be sold and stating that the described property would be sold at <br />public auction to the highest bidder for cash or certified or cashier's check, at at the lower level lobby of the Hall <br />County Courthouse, 1st & Locust Street, Grand Island, Hall County, Nebraska at 10:00 A.M. on January 16, <br />2020. Publication of such notice was made for five consecutive weeks on November 28, 2019, December 5, <br />2019, December 12, 2019, December 19, 2019 and December 26, 2019, the last publication being at least ten (10) <br />days but not more than thirty (30) days prior to the date of sale. <br />A copy of such notice of the time and place of sale was thereafter mailed to all parties entitled to notice <br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008. <br />Pursuant to said Notice of Trustee's Sale, John D. Sabott, attorney for Grantor, did at the time and place <br />mentioned in said Notice of Trustee's Sale, offer said property for sale at public auction, and did sell the same to <br />Grantee for the sum of $69,000.00, it being the highest bidder therefor. <br />NOW, THEREFORE, in consideration of the premises and of the sum of $69,000.00 so bid and paid as <br />aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its successors and assigns forever, all the <br />estate, right, title and interest of which the said Wayne E.
