Certain rules regarding the usage of words used in this document are <br />set forth below in one or more sections of this document. <br />"Security Instrument" means this document, which is dated January 17, 2020, together with all <br />attachments and riders to this document, and any other document executed by the Borrower in connection <br />with the Loan. <br />"Borrower" is Lake Mac Properties, LLC, a Nebraska limited liability company. Borrower's address <br />is 2 O'Connor Drive, Ogallala, Nebraska 69153. Borrower is the mortgagor under this Security Instrument. <br />"Lender" is Residential Capital Partners Secured Loan Fund XIV, LLC. Lender's address is 3838 <br />Oak Lawn Ave., Suite 1500, Dallas, TX 75219. Lender is the mortgagee under this Security Instrument. <br />"Trustee" is Old Republic National Title Insurance Company. Trustee's address is 400 Second <br />Avenue South, Minneapolis, MN 55401. <br />"Note" means the promissory note signed by Borrower and dated the same date as this Security <br />Instrument. The Note states that Borrower owes Lender US$76,934.00, plus interest. Borrower has promised <br />to pay this debt in regular Periodic Payments and to pay the debt in full not later than the maturity date <br />specified in the Note. <br />"Property" means the following real and personal property: <br />a. That certain property set forth and described on Exhibit "A"attached hereto and made a part <br />hereof, which has an address of 1905 N Sherman Blvd., Grand Island, Nebraska 68803. <br />b. All building material, machinery, apparatus, equipment, fittings, fixtures and personal property <br />of every kind and nature whatsoever, now in, part of, affixed to, delivered to or used in <br />connection with the buildings and improvements on the Property, or hereafter acquired by the <br />Borrower and hereafter placed in, affixed to, delivered to or used in connection which such <br />buildings and improvements or any buildings hereinafter constructed or placed upon the <br />Property or any part thereof, including, but without limiting the generality of the foregoing, all <br />engines, furnaces, boilers, stokers, pumps, heaters, tanks, dynamos, transformers, motors, <br />generators, fans, blowers, vents, switchboards, electrical equipment, heating, plumbing, <br />lifting and ventilating apparatus, air-cooling and air-conditioning apparatus, water, gas and <br />electrical fixtures, elevators, mail conveyors, escalators, drapes, carpets, shades, awnings, <br />screens, radiators, partitions, ducts, shafts, pipes, conduits, lines and facilities of whatsoever <br />nature for air, gas, water, steam, electricity, waste sewage and for other utilities, services and <br />Deed of Trust and Security Agreement (NE) Page 1 <br />
